L- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, APPROVING AN AMENDMENT TO TEXAS CAPITAL FUND CONTRACT NO. 714392 BETWEEN THE CITY OF GEORGETOWN AND THE TEXAS DEPARTMENT OF ECONOMIC DEVELOPMENT ON BEHALF OF TEXAS ELECTRIC COOPERATIVES; AUTHORIZING THE CITY MANAGER TO ACT ON THE CITY'S BEHALF WITH REGARD TO THE SUBMISSION OF THIS AMENDMENT REQUEST; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Georgetown applied for a Texas Capital Fund Grant from the Texas Department of Economic Development on behalf of Texas Electric Cooperatives, Inc. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this resolution implements the following policies of the Century Plan - Policy Plan Element: Economic Development Policy End 1.0, which states: "Georgetown's economy is self-sustaining through diversified growth, a broad tax base wit minimal impact from economic fluctuation, enhanced business opportunity and job creation." SECTION 2. The City Council has reviewed and approves the change in the Performance Statement for Texas Electric Cooperatives per the attached Exhibit A. The Council acknowledges that the change is necessary to reflect the infrastructure improvements that are to be built. SECTION 3. The City Council has reviewed and approves the change in the contract budget for Texas Electric Cooperatives per the attached Exhibit B. The Council acknowledges that the change is necessary to reflect the funds necessary to build the improvements that were modified in part by the Texas Department of Transportation. SECTION 4. The City Council has reviewed and approves a change in the Special Conditions regarding review of the water line extension by the Texas Natural Resource Conservation Commission. SECTION 5. The City Manager is authorized to execute the amendment and TEC Resolution No. ?o //,2 q-4 Page 1 of 2 otherwise act on the City's behalf in all matters pertaining to the submission of this amendment. SECTION 6. The Mayor is hereby authorized to execute, and the City Secretary to attest thereto this resolution on behalf of the City of Georgetown. SECTION 7. (hereinafter referred to as the Company). This is a two (2) part phased project, with Part I consisting of the building construction, and Part 11 consisting of the infrastructure improvements as specified within this contract. These improvements will allow the Company to relocated from Austin, Texas, to the City of Georgetown. The Company is a statewide service organization for electric cooperatives operating in Texas. Financial Information Contractor shall expend a total of Four Hundred Forty-four Thousand Seven Hundred Eighty and no/100 Dollars ($444,780.00), of contract funds, for the following infrastructure activities: Contractor shall expend Ninety Thousand and No/100 Dollars ($90,000.00) of contract funds for road improvements, mobilization, preparation of right -of -say, unclassified excavation, barricades and signage, and environmental work. Contractor shall install approximately nine hundred seventy linear feet (9701.£) of forty foot (40 ft.) Wide HMAC street with a twelve inch (12") compacted base, twenty-four inch (24") standard curb and gutter, and sixty .foot (60 ft.) right-of-way. The roadway will begin at Austin avenue (U. S. 81) and run east towards County Road 115. Contractor shall expend Fifty Thousand Two Hundred Fifty and No/100 Dollars ($50,250.00) of contract funds for water improvements, mobilization, and barricades and signage. Contractor shall install approximately nine hundred seventy linear feet (9701.f.) of eight -inch (8") water line, with four (4) valves and other appurtenances. The water line will begin at Austin avenue (U.S. 81) and run east, parallel to the proposed forty foot (40 ft.) roadway, towards County Road 115. Contractor shall expend Thirty-eight Thousand Eight Hundred and No/ 100 Dollars ($38,800.00) of contract funds for sewer improvements, mobilization, and barricades and signage. The contractor shall install approximately nine hundred seventy linear feet (9701.f.) of ten -inch (10") sewer line and three (3) manholes. The sewer line will begin at Austin Avenue (U. S. 81) and run east, parallel to the proposed forty foot (40 ft.) roadway, towards County Road �1 115. Contractor shall expend Two Hundred Sixty-five Thousand Seven Hundred Thirty and No/100 Dollars ($265,730.00) of contract funds for drainage improvements, mobilization, and barricades and signage. The contractor shall install approximately six hundred linear feet (600 l.f.) of reinforced concrete pipe (24" storm water line), approximately twenty eight hundred linear feet (2,8001.f.) of reinforced concrete pipe (36" storm water line), a water detention pond, and a water quality pond. The 24" storm water line will start at County Road 115 and run north to the proposed forty foot (40 ft.) roadway, turn west and run parallel to the proposed roadway. The 36" storm water line will start at the pond and run north parallel to Austin Avenue (U.S. 81) to an existing culvert under Austin Avenue (U.S. 81). The detention pond and water quality pond will be located in the northwest corner of the proposed site. Contractor shall ensure that the Company injects One Million and No/100 Dollars ($1,000,000.00) in cash for payroll costs as working capital. Contractor shall provide to Commerce, upon request, evidence that project funds, both public and private and contract, were expended as specified in this EXHIBIT A and in EXHIBIT B of this contract. Engineering Contractor shall expend Fifty Thousand and No/100 Dollars ($50,000.00) of contract finds for eligible project -related engineering services, including preliminary and final design plans and specifications, interim and final inspections. Contractor shall expend Forty Thousand and No/100 Dollars ($40,000.00) for basic engineering services and Ten Thousand and No/100 Dollars ($10,000.00) for special engineering services. Administration Contractor shall expend Thirty-five Thousand and No/100 Dollars ($35,000.00) of contract funds to carry out project administration activities, including the cost associated with the required program fiscal and compliance audit. Project Outcomes As a result of this project, Contractor shall ensure that the Company creates twenty-three (23) jobs of which fifty-one percent (51%), or twelve (12), shall be held by low and moderate income persons prior to the expiration date of this contract. In the event more than twenty-three (23) permanent jobs are created, Contractor shall ensure that at least fifty-one percent (51%) of all jobs crated, during the contract period, are held by low and moderate income persons, with hiring priority given to Georgetown residents. Contractor shall also ensure that the Company pays a minimum of twelve (12) of the permanent positions created a minimum weekly wage of Three Hundred Two and 94/100 Dollars ($302.94), which is 120% of the CAS.
