A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS, CLARIFYING THE INTENT OF THE SERVICE
PLAN FOR THE BERRY CREEK SUBDIVISION IN REGARD TO
WASTEWATER SERVICE FOR BERRY CREEK SUBDIVISION, SECTION
1.
WHEREAS, the City of Georgetown annexed the Berry Creek Subdivision into the
Georgetown City Limits in December, 1996; and
WHEREAS, at the time of annexation, a service plan was adopted dealing with wastewater
service; and
WHEREAS, questions have since arisen concerning interpretation of the service plan; and
WHEREAS, clarification of intent is needed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF GEORGETOWN, TEXAS, THAT:
SECTION 1. The facts and recitations contained in the preamble of this resolution are
hereby found and declared to be true and correct, and are incorporated by reference herein and
expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this
resolution implements the following policy or policies of the Century Plan - Policy Plan Element:
Growth and Physical Development Policy End 7.0, which states:
"Georgetown's land uses support economic, cultural, and social activities for
all residents, business, and organizations; and the City's development process
encourages new and infill development."
2. Utilities/Energy Policy End 14.0, which states: "Georgetown's utility systems
provide safe and reliable service which meets the needs of all citizens and promotes
the economic health of the community."
SECTION 2. The lots in Berry Creek, Section 1, are large enough to maintain fully -
permitted wastewater septic systems. Therefore, the City has no current plans to provide an
organized wastewater collection system in Berry Creek, Section 1.
SECTION 3: If a septic tank should fail, homeowners are encouraged to replace the system
through the permitting process through the Williamson County Health District.
SECTION 4: The City staff is hereby instructed to work with individual affected property
owners if a septic tank should fail or if the property owner should desire to connect to the
wastewater system. In the event the lot is vacant, staff is to work with the property owner to

determine the least expensive approach for the homeowner. In the event the line can be extended
at a cost acceptable to the property owner, the staff is authorized to extend the collection line.
SECTION 5: Should the City, at some point in the future, extend a wastewater collection
system into Berry Creek, Section 1, the Council will use as a guide, the policy utilized during the
1997 Serenada annexation, wherein the City collected, through fees, approximately 35 percent of
the total cost of the wastewater collection system.
SECTION 6. The Mayor is hereby authorized to execute, and the City Secretary to attest
thereto this resolution on behalf of the City of Georgetown.
SECTION 7. This resolution shall be effective immediately upon adoption.
