A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, APPROVING A CHANGE TO THE CONTRACT BY CONTRACT AMENDMENT BETWEEN THE CITY OF GEORGETOWN AND THE TEXAS DEPARTMENT OF ECONOMIC DEVELOPMENT REGARDING THE ALU -CUT INTERNATIONAL TEXAS CAPITAL FUND CONTRACT; AUTHORIZING THE MAYOR TO ACT ON THE CITY'S BEHALF WITH REGARD TO THE SUBMISSION OF THIS AMENDMENT REQUEST; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council has reviewed and approves the change in the project site for Alu-Cut International from the original site identified in the Texas Capital Fund application to: A 2.708 acre tract in the Clement Stubblefield Survey, Abstract Number 558, in Williamson County, Texas. WHEREAS, the City Council has reviewed and approves the change in the budget outlined in the new Performance Statement, and WHEREAS, the City Council has reviewed and approves the change requested in the Special Conditions to allow the City to draw acquisition funds for reimbursement to the City prior to being allowed to draw construction funds. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this resolution implements the following policy or policies of the Century Plan - Policy Plan Element: Economic Development Policy End 1.0, which states: "Georgetown's economy is self-sustaining through diversified growth, a broad tax base with minimal impact from economic fluctuation, enhanced business opportunity and job creation." SECTION 2. The Mayor is authorized to execute the amendment and otherwise act on the City's behalf in all matters pertaining to the submission of this amendment. SECTION 3. The Mayor is hereby authorized to execute, and the City Secretary to attest thereto this resolution on behalf of the City of Georgetown. SECTION 4. This resolution shall be effective immediately upon adoption. Contractor shall ensure a total of Four Hundred Six Thousand Nine Hundred Fifty-five and No/ 100 Dollars ($406,955.00) of contract funds are expended for construction of the building to include dirt work, asphalt paving, construction of the concrete slab, erection of the metal building, electrical wiring work, overhead crane systems, plumbing, HVAC, site utilities, alarm system, and chain link fence. Contractor shall ensure that the Company expends or finances Three Hundred Forty-eight Thousand Four Hundred Eight -five and No/100 Dollars ($34$,485.00) for the purchase of machinery and equipment from Rutland Tool & Supply Company, Inc. Contractor shall ensure that the Company contributes One Hundred Twenty-five Thousand Six Hundred Forty and No/100 Dollars ($125,640.00) of equity value In machinery and equipment (fixed assets) as match to be located at the new project site. Contractor shall ensure that the Company injects Five Thousand Eight Hundred Seventy-five and No/100 Dollars ($5,875.00) in cash for labor costs as match for working capital. Administration Contractor shall expend Thirty-five Thousand and No/100 Dollars ($35,000.00) of contract funds to carry out project administration activities, including the cost associated with the required program fiscal and compli- ance audit, Project Outcomes As a result of this project, Contractor shall ensure that the Company creates twenty-two (22) jobs of which fifty-one percent (51 %), or twelve (12), shall be held by low and moderate Income persons prior to the expiration date of this contract. In the event more than twenty-two (22) permanent jobs are crenated, Contractor shall ensure that at least fifty-one percent (51 %) of all jobs created, during the contract period, are held by low and moderate Income persons.
