HomeMy WebLinkAboutRES 961118-E - Gulley SettlementRESOLUTION NO.% 1S- C A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, AUTHORIZING THE MAYOR TO SIGN A COMPROMISE, RELEASE AND SETTLEMENT AGREEMENT WITH MICHAEL H. GULLEY, TRUSTEE, THE RIVERY JOINT VENTURE, DAVID STARR, GREGORY G. HALL, ED HAMEL, BARRY GILLINGWATER, AND THOMAS C. DUNHAM; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City of Georgetown, a Texas Home Rule Municipal Corporation ("City"), is currently a party in Cause No. 96-399-C26, Michael H. Gulley, Trustee v. The Rivery Joint Venture, David Starr, and Gregory G. Hall, in the 26th District Court of Williamson County, Texas ("Lawsuit"); and WHEREAS, the City and the other parties to the Lawsuit desire to resolve these disputes involved in the Lawsuit through the execution of the Compromise, Release and Settlement Agreement as agreed by the City and the Parties; and WHEREAS, the City Council has reviewed the proposed Compromise, Release and Settlement Agreement and has determined that the execution of this agreement is in the best interest of the City; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this resolution implements Finance Policy 1 of the Century Plan - Policy Plan Element, which states: "The City will conduct all municipal operations in an efficient business -like manner"; and further finds that the adoption of this resolution is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2. The Mayor is hereby authorized to execute on behalf of the City of Georgetown, and the City Secretary to attest thereto, the proposed Compromise, Release and Settlement Agreement regarding the Lawsuit.
