HomeMy WebLinkAboutRES 961126-X - Lease Agmt Adyl Aviation111 RESOLUTION NO. 74P /�� V _ /` A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, AUTHORIZING THE MAYOR TO SIGN A LEASE AGREEMENT WITH ADYL AVIATION, INC., FOR APPROXIMATELY 140,000 SQUARE FEET OF AIRPORT PROPERTY, AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, Adyl Aviation, Inc., has proposed to lease that certain area of the Georgetown Municipal Airport where City -owned Hangars A and B are now located (approximately 140,000 square feet as shown on the attached Exhibit "A"; and, WHEREAS,Adyl Aviation, Inc., also proposes to remove these hangars and construct a new 12,000-15,000 square foot hangar and office space to accommodate a full-service corporate and general aviation FBO (fixed -base operator); and, WHEREAS, this proposal conforms with the Airport Layout Plan (ALP), the Terminal Area Plan, and the Airport Master Plan now in progress, and, WHEREAS, the Airport Advisory Board voted unanimously to recommend that Council approve this proposal; and, WHEREAS,the City Council hereby finds that this proposal from Adyl Aviation, Inc., is in the best interests of the development of the Georgetown Municipal Airport. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: Section 1. The facts and recitations contained in the preamble of this resolution are found to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this resolution implements the following policies of the Century Plan - Policy Plan Element: 1. Economic Development Policy End 1.0, which states, "Georgetown's economy is self- sustaining through diversified growth, a broad tax base with minimal impact from economic fluctuation, enhanced business opportunity and job creation." 2. Transportation Policy End 12.0, which states, "Georgetown's transportation system provides for the safe and efficient movement of traffic, promotes the economic interests of the community, and adequately serves the needs of individuals." Section 2. The Lease Agreement will be the standard 20 -year lease with a 10 -year option to renew, and the rental rate will be $0.10 per square foot per year with the standard 5 -year CPI escalation clause. The City agrees that any existing environmental conditions and any associated remediation and/or clean-up costs at the site will be the responsibility of the City. Section 4. Adyl Aviation, Inc., agrees to allow T -Hangar B to remain in use for a maximum of two years, or until the City is able to provide alternate hangar space for the current lessees, whichever occurs first. The City agrees to give Adyl Aviation, Inc., up to four years from the date of execution of the Lease Agreement to begin construction on a second hangar. Adyl Aviation, Inc., will be responsible for any costs related to the removal of Hangars A and B. Section 5. The Mayor is hereby authorized to execute, after negotiation by staff and approval of the City Attorney, and the City Secretary to attest thereto on behalf of the City of Georgetown, the Airport Lease Agreement. Section 6. This resolution shall become effective immediately upon adoption. RESOLVED THIS 26TH DAY OF NOVEMBER, 1996. Attest: Sandra D.
