A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS, AUTHORIZING THE MAYOR TO SIGN A
RESOLUTION ESTABLISHING A POLICY ON CLAIMS AGAINST THE
CITY.
WHEREAS, the Council wishes to clarify the actions to be taken in the event of a claim,
Encluding authorization of certain discretionary action by the City Manager,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF GEORGETOWN, TEXAS, THAT:
SECTION 1. The facts and recitations contained in the preamble of this resolution are
hereby found and declared to be true and correct, and are incorporated by reference herein an
expressly made a •. hereof, as if copied verbatim. The City Council hereby finds that this
resolution implements Finance Policy 1, which states- "All municipal operations are conducted
in an efficient businesslike manner"; and further finds that the adoption of this resolution is not
inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of
the Administrative Chapter of the Policy Plan.
The Texas Tort Claims Act gives cities total immunity unless the backup
is caused by motor -driven equipment (e.g. when the City uses a roto -
rooting procedure to clean the lines).
It is the policy of the City to file all claims against the City with the
appropriate City insurer, whenever a potential claim is made apparent to
the City. For all uninsured claims, or claims below the City's insurance
deductible, the claims are reported to the City Attorney's Office to provide
mitigation of the risk exposure. For uninsured claims, the City Manager
is authorized to pay claims for actual expenses incurred under $2,000,
when it is determined by the City Manager and City Attorney to be in the
best interest of the City for mitigation of the liability of the claim.

SECTION 3. The Mayor is hereby authorized to execute, and the City Secretary to attest
thereto this resolution of the City of Georgetown.
SECTION 3. This resolution shall be effective immediately upon adoption.
