WHEREAS, the Lower Colorado River Authority (LCRA) has initiated a multi -jurisdictional effort
Lo explore options and alternatives for the management of solid waste from a regional perspective to
I aximize efficiencies while promoting the protection of the environment; and,

WHEREAS, proper control and management of solid waste is essential to the control of water
pollution, illegal dumping, and in protecting and conserving the State's natural resources; and,
WHEREAS, the State has mandated through legislation and through rules and regulations that solid
waste management planning be conducted on a regional and local basis, and that such planning incorporate
9-n integrated management approach;
WHEREAS, it is the policy of the State for local governments and public agencies to cooperate with
one another and to explore options and alternatives in managing solid waste on a regional and sub -regional
basis; and such cooperation will be of mutual benefit to participating governments by producing more
efficient and cost-effective solutions; and,
WHEREAS, LCRA, in cooperation with local governments, including the City of Georgetown, has
conducted screening, feasibility, and implementation studies for solid waste management and has made
recommendations pursuant to such studies; and,
WHEREAS, LCRA, as a regional public agency, possessing multi -county jurisdiction is uniquely
positioned to provide leadership in coordination of regional, sub -regional and local solid waste planning and
implementation; and,
WHEREAS, LCRA and the City of Georgetown are authorized to enter into interlocal agreements
under the LCRA Act, the Texas Solid Waste Disposal(Chapter 361, Health & Safety Code), the
Municipal Solid Waste Act, (Chapter 363, Health & Safety Code), the County Solid Waste Act, (Chapter
364, Health & Safety Code), the Regional Waste Disposal Act, (Chapter 30, Texas Water Code), and other

WHEREAS, the value of recycled materials is enhanced when delivered to end-users in a cl
segregated, and substantial quantity; and, 1
WHEREAS, the purpose of this cooperative effort between LCRA and the City of Georgetown will
be to solicit proposals for the creation, acquisition, construction, and development of a regional or
subregional recycling cooperative; and,
WHEREAS, the City o Georgetown esires to e in u in t is cooper e process, ut
understands that it will have an opportunity to take further action prior to determining whether to
participated in construction of projects, execution of contracts, or expenditure of any funds; and,
WHEREAS, the City of Georgetown hereby expresses its desire to -participate with the LCRA in
exploring options and alternatives in the development and creation of a sub -regional or regional recycling
cooperative-,
NOW, THEREFORE, be it resolved by the City Council of the City of Georgetown, Texas, that:
SECTION 1
The facts and recitations contained in the preamble of this resolution are hereby found and declared
to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if
copied verbatim. The City Council finds that this resolution implements Utilities & Energy Policy #5 of
the Century Plan -Policy Plan Element, which states, "The City will provide water, wastewater, electricity,
and solid waste collection services which meet the immediate and future needs of all citizens and which
encourages and provides for economic development," and further finds that the adoption of this resolution
is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the
Administrative Chapter of the Policy Plan.
SECTION 2
A. LC RA is authorized by the City of Georgetown to:
1. Develop a regional or subregional recycling cooperative; and,
2. Seek and secure funding or in-kind services from the Texas Natural Resources Conservation
commission (TNRCC), or any other sources that may be available, for development of the
projects contemplated by this resolution; and,
3. Solicit bids or proposals for sale of recycled or recyclable materials; and,
44. Engage in any other activity that will further the purposes and goals of this resolution.
B. In connection with the authority granted herein to LCRA, the City of Georgetown understands that -
1. The LCRA is authorized to hire and manage such consultants as may be necessary to further
the purposes and goals of this resolution; and,

2. The LCRA may represent to potential recyclable materials buyers reasonable estimates of
recycled material volumes that the City of Georgetown can provide, based on the population
of the relevant service area.
C. The City of Georgetown acknowledges and certifies that -
1. It will comply with the provisions of the State's Solid Waste Management Plan and TNRCC
Financial Assistance Program and that it will cooperate and support LCRA in its effort to
achieve compliance with the state Plan and Financial Assistance Program; and,
2. Any program or project hereinafter developed will conform to the local solid waste
management plan and any applicable TNRCC approved regional or subregional plan; and,
3. The City of Georgetown will cooperate with the LCRA in developing and providing the
information necessary to prepare requests for proposals issued pursuant to th s resolution;
4. All land or facilities intended to be included in recycling cooperatives will be owned or
otherwise controlled by the City of Georgetown.
D. The City of Georgetown agrees to adopt future resolutions or enter into interlocal agreements as may
be necessary to effectuate the purposes and goals of this resolution.
SECTION 3
The Mayor is hereby authorized to execute, and the City Secretary to attest thereto to this resolution
on behalf of the City of Georgetown.
SECTION 4
This resolution shall be effective immediately upon adoption.
