GEORGETOWN, TEXAS, DIRECTING THE CITY'S ATTORNEY TO
MAINTAIN A JOINT WATER AND WASTEWATER CERTIFICATE
OF CONVENIENCE AND NECESSITY APPLICATION CURRENTLY
PENDING BEFORE THE TEXAS NATURAL RESOURCE
CONSERVATION COMMISSION.
WHEREAS, the Del Webb Corporation has secured options and indicated their desire
to locate an active retirement community within the Georgetown area; and
WHEREAS, the Del Webb Corporation has expressed to the City that they desire
water and wastewater services from the City of Georgetown; and
WHEREAS, the City of Georgetown has filed an application with the Texas Natural
Resource Conservation Commission (INRCO) to de -certify a portion of Certificate of
Convenience and Necessity No. 11590 of Chisholm Trail Special Utility District in
Williamson County, (Application No. 30459-C), to secure the right to provide water service;
and to secure the right to provide wastewater service (Application No. 30460-C))
WHEREAS, the TNRCC has scheduled negotiation meetings for August 17, 1994, and
a preliminary hearing has been scheduled for August 26, •®L
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF GEORGETOWN, TEXAS, THAT -
SECTION 1. The facts and recitations contained in the preamble of this resolution are
hereby found and declared to be true and correct, and are incorporated by reference herein
and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that
this resolution implements Utilities/Energy Policy 5 of the Century Plan - Policy Plan
Element, which states: "The City will provide water, wastewater, electricity, and solid waste
collection services which meet the immediate and future needs of all citizens and which
encourages and provides for economic development"; and further finds that the adoption of
this resolution is not inconsistent or in conflict with any other Century Plan Policies, as
required by Section 2.03 of the Administrative Chapter of the Policy Plan.
SECTION 2. The City Council hereby determines that it is in the best interest of the
City of Georgetown to provide both water and wastewater service to the proposed Del Webb
development and that the applications for the Certificates of Convenience and Necessity for
water (Application No. 30459-C) and wastewater (Application No. 30460-C) be considered
jointly by the Texas Natural Resource Conservation Commission. The City Council further

determines that under no circumstance shall these applications be severed or considered
separately.
SECTION 3. The City Secretary is hereby directed to forward a certified copy of this
resolution to the Hearings Examiner of the Texas Natural Resource Conservation Commission
who is reviewing the City's applications.
