VIIIEREAS, the City Council added a cafeteria plan in October 1990 with an amendme in 1992 to the list of benefits provided to City employees; I WBEREAS, the City Council finds that including term life insurance and requiring eacm participant to sign a statement regarding their federal income tax return is not feasible in Cafeteria Plan; NOW� THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this resolution implements Finance Policy 1 of the Century Plan - Policy Plan Element, which states: "The City will conduct all municipal operations in an efficient business -like manner"; and further finds that the adoption of this resolution is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2 The Mayor is hereby authorized to execute, and the City Secretary to attest thereto an -amendment to the Cafeteria Plan on behalf of the City of Georgetown. SECTION 3. The purpose of this Health Expense Reimbursement Plan is to provide for the reimbursement of certain qualified health expenses to Participants. This supplement constitutes the health expense reimbursement plan of the City • georgetown. The benefit provided under this Supplement is a "reimbursement ►, 1.2 Effective Date. The Health Expense Reimbursement Plan is effective as of October 1, 1991. 1.3 Plan Administration, Plan Year. The Health Expense Reimbursement Plan is administered by the City of Georgetown • the basis of a plan year as identified in Article H of the City of Georgetown Employee Cafeteria Plan. For participation provisions, see Article III of the City of Georgetown Employee Cafeteria Plan. Contributions For Contributions provisions, see Article IV, Section 4.10 of the City of Georgetown F---mployee Cafeteria Plan. • the maximum amount allowed Participant contribution per plan year will not exceed ONE THOUSAND ONE HUNDRED AND NO/100'S ($1,100.00) per plan year. Subject to the conditions and limitations of the Plan, each year each Participant may elect in writing on a form filed with the Plan Administrator on or before the date he first becomes eligible to participate in the Plan, and on or before the iFirst day of any plan year thereafter, to be reimbursed for the City the health expense costs (ad defined in paragraph 2) incurred during that year by him or her to the extent that such costs do not exceed an amount equal to the lessor of: I ,,a) The total qualified health expense costs paid by the Participant and attributable to health care services rendered during the plan year and regardless of whether such cost are paid by the Participant during such plan year; or (b) the amount allocated by the Participant to this benefit. 2. Costs. The term "health expense costs," as used in the plan, means amounts paid by a Participant for non -covered health-related expenses that meet the criteria for deductibility as medical expenses under Internal Revenue Code Section 213(e) including, but not limited to, noncovered medical expenses, vision and hearing expenses, dental expenses not covered under a current dental plan, and noncovered prescription drug expenses. 3. Manner of Making Payments As of the pay date of each month, the City shall reimburse each participant for the portion of health expense costs that is payable to him under paragraph 1. Reimbursement for qualified expenses is limited to the account balance of deductions reduced by any prior reimbursements. 4. Non -duplication of Benefits. A participant shall not be reimbursed for health expense costs under this Plan to the extent that such costs are paid to •` for the benefit of the Participant, or to or for the benefit of any individual included in his or her family unit, under provision of any other health care or cafeteria plan. Participants shall not be eligible to deduct such costs as expenses on their individual Federal income tax returns.
