WHEREAS, construction of the Frontage Road will improve traffic safety for the citizera of the community by reducing the amount of traffic entering 1-35 at Highway 29 and exiting FM 2338 by providing an alternate route to travel between Highway 29 and FM 2338; WHEREAS, construction of the Frontage Road will greatly improve access to abutting properties; and WHEREAS, the City of Georgetown, with broad support of the Georgetown Community, requested the Texas Transportation Commission to construct said Frontage Road-, and WHEREAS, the Texas Department of Transportation prepared a cost estimate for construction of the Frontage Road in the amount of $3,682,000.00; and I WHEREAS, the City of Georgetown proposed to contribute a portion of the fundirim towards construction of the Frontage Road, which the City would recover from assessments up the adjacent property; and I WHEREAS, on June 29, 1993, the Texas Transportation Commission issued Minute Order 102420 authorizing construction of the Frontage Road; and WHEREAS, said Minute Order required the City to provide $1,000,000.00 towards construction of said Frontage Road; and WHEREAS, the City Council has determined that it is in the best interest of the City and of special benefit to the adjacent properties that the Frontage Road be constructed; WHEREAS, the City Council has determined that it is in the best interest of the City that the City comply with Article 1105b of the Texas Revised Civil Statutes and assess the adjacent properties to the maximum allowable benefit received by the property due to the construction of ,0% Off oCP d*" " . AAM Frontage Road Amended Ren solutioNo. 707 -Y A. 01" Page 1 of WHEREAS, the City of Georgetown has 90 days from the issuance of the Commission's Minute Order to accept the Commission's offer; NOW, THEREFORE9 BE IT RESOLVED BY THE CITY COUNCIL OF TH CITY OF GEORGETOWN, that: i SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this resolution implements the following policies of the Century Plan - Development Plan Element: 1. Transportation Policy 15, which states: "The City will encourage a transportation system that provides for the safe and efficient movement of traffic, promotes the economic interests of the community, and adequately serves the personal needs of individuals;" and further finds that the adoption of this resolution is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2. The City Council adopts the cost estimate prepared by the Texas Department of Transportation in the amount of $3,682,000.00 (attached as Exhibit for the construction of the northbound frontage road from State Highway 29 to F.M. 2338 (Williams Drive), and authorizes the City staff to initiate the process for assessments against adjacent properties in compliance with Article 1105b of the Texas Revised Civil Statutes in order to recover the maximum amount of the City's funds that will be invested in this project as described in Section 3. It is the City's intent to recover the highest allowable amount from the adjacent property owners, not to exceed the special benefits received by the properties as may be determined in accordance with State law. SECTION 3. 'Me City of Georgetown accepts the Texas Transportation Commission Minute Order 102420 of June 29, 1993 and agrees to provide a fixed sum in the amount $1,000,000.00. 1 SECTION 4. This resolution shall take the place of Resolution No. 930914 -CC adopted by the City Council on September 14, 1993. This Resolution shall become effective immediate y or adoption.
