HomeMy WebLinkAboutRES 931026-V - East I-35 Frontage Rd ProjectWHEREAS. the City of Georgetown recognizes the importance for constructing the East Frontage Road on 1-35 from Highway 29 to FM2338 (Williams Drive); and WHEREAS, construction of said Frontage Road will provide greatly improved acce to abutting properties; and WHEREAS, due to improved access, property values of adjacent properties will be enhanced; and WHEREAS, the City of Georgetown, has accepted the Texas Transportation Commission's Minute Order 102420 of June 29, 1993 concerning construction of the East Frontage Road of 1-35 from Highway 29 to FM2338; and WHEREAS, adjacent properties will receive direct benefit as a result of the improvements being made; and )WHEREAS, the City Council has determined that it is in the best interest of the Cit for the benefitting properties to assist in funding the construction of these improvements; WHEREAS, the City is authorized by State law to assess benefitted properties for t actual costs of construction of roadway improvements; NOW, THEREFORE, BE IT RESOLVED BY THE CrrY COUNCIEL OF THE Crry OF GEORGETOWN, that: SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this resolution implements the following policies of the Century Plan - Development Plan Element: 1. Transportation Policy 15, which states: "The City will encourage a transportation system that provides for the safe and efficient movement of traffic, promotes the economic interests of the community, and adequately serves the personal needs of individuals;" 2. Economic Development Policy I which states: "The City will encourage diversified growth and promote business opportunities to create jobs, broaden the tax base and minimize the impact of economic fluctuations-" 3. Finance Policy 1 which states: "The City will conduct all Municipal operations in an efficient business -like mannen," and further finds that the adoption of this resolution is not inconsistent or in conflict with any 1-35 Frontage Road Public Hearing Resolution NO. i3L(11�L V Page I of "3 other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2., Project Description. The total project will consist of the construction of the East 1-35 Frontage Road from Highway 29 to FNU338 (Williams Drive) ("Frontage Road Project"). The City will fund $1,000,000.00 of the total project costs of the Frontage Road identified on Exhibit A. The Frontage Road Project includes the City's portion of all road improvements including bridges, curb and gutters, base, surfacing, drainage improvements, culverts, and any other appurtenances designed and approved by the Texas Department of Transportation for constructing of the Frontage Road. SECTION 3.1 Cost Estimate. The City adopted the cost estimate for the construction of the Frontage Road in Resolution 930928 -AA, in the amount of $3,682,000.00 as shown in Exhibit B. By agreement with the Texas Department of Transportation, the City will provide fundina in the amount of $1,000,000.00 toward the costs of constructing the Frontage Road Project described in Section 2. SECTTON 4. Proposed Assessment The City will require all benefitting properties abutting the Frontage Road Project to pay their portion of the costs in accordance with the requirements of Article 1105b, Texas Revised Civil Statutes. The method of assessment shall be established after the public hearing. The actual assessment valuations will be set by the City Council after appropriate notices and public hearing and shall be limited to the special benefits attributed to each tract, according to the determination of special benefits made by the City Council in accordance with State law.
