AND ESTABLISHING AN EFTECTIVE DATE.
WHEREAS, the Lower Colorado River Authority (LCRA) has initiated a multi -jurisdictional effort
to explore options and alternatives for the management of solid waste from a regional perspective to
maximize efficiencies while promoting the protection of the environment; and,
WHEREAS, new regulations, landfill closures and reduced landfill capacity have made solid waste
management a critical issue to local governments, and regional solutions are urgently required; and,
WHEREAS, proper control and management of solid waste is essential to the control of water
pollution, and in protecting and conserving the State's natural resources; and,
114'KEREAS, local governments are required by Chapter 363 of the Texas Health and Safety Code
to develop local solid waste management plans; and,
WHEREAS, the State has mandated through legislation and through rules and regulations that solid
waste management p anning be conducted on a regional and local basis and that such planning incorporate
an integrated management approach; and,
WHEREAS, LCRA recognizes the continuing role of regional planning councils in municipal solid
waste management planning and plan implementation coordination as defined in SubChapter 0 of the Texas
Water Commission's Municipal Solid Waste Management Regulations and the Board of Directors of LCRA
has adopted a resolution to work with regional planning councils and other governmental entities in the
develo]cment of

WHEREAS, it is the policy of the State for local governments and public agencies to cooperate with
one another and to explore options and alternatives in managing solid waste on a regional basis and such
cooperation will be of mutual benefit to participating governments by producing more efficient and cost-
effective solutions; and,

situated to provide leadership in coordination of region
implementation; and,

WHEREAS, LCRA and the City of Georgetown are authorized to enter into interlocal agreements
under the LCRA Act, the Texas Solid Waste Disposal Act (Chapter 361, Health & Safety Code), the
Municipal Solid Waste Act (Chapter 363, Health & Safety Code), the County Solid Waste Act (Chapter
364, Health & Safety Code), the Regional Waste Disposal Act (Chapter 30, Texas Water Code), and other
applicable laws; and,
WHEREAS, the purpose of this cooperative effort between LCRA and the City of Georgetown will
be to prepare and submit local plans to the Texas Water Commission as required by statute and to initiate
feasibility, screening, and implementing analyses necessary to identify facilities which can serve the region
which the City of Georgetown is a part in a cost-effective, efficient and environmentally sensitive manner;
and,
WHEREAS, the City of Georgetown desires to be included in this cooperative regional process,
but understands that it will have an opportunity to take further action prior to determining whether to
r-tarticipated in construction of projects.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
GEORGETOWN', TEXAS, THAT:
SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found
9nd declared to be true and correct, and are incorporated by reference herein and expressly made a part
hereof, as if copied verbatim. The City Council hereby finds that this resolution implements
Utilities/Energy Policy 5 of the Century Plan - Policy Plan Element, which states- "The City will provide
water, wastewater, electricity, and solid waste services which meet the immediate and future needs of all
zitizens and which encourage and provide for economic development" and further finds that the adoption
*f this resolution is not inconsistent or in conflict with any other Century Plan Policies, as required by
Section 2.03 of the Administrative Chapter of the Policy Plan.
SECTION 2. The Mayor is hereby authorized to execute, and the City Secretary to attest thereto
an agreement with the LCRA on behalf of the City of Georgetown which hereby expresses the City of
Georgetown's desire to participate with the LCRA in exploring options and alternatives in managing solid
waste from a regional integrated waste management perspective. In furtherance of this official interest, the
City

LCRA is authorized and the City of Georgetown hereby appoints LCRA as its agent to:
A. seek and secure funding from the Texas Water Commission, or any other sources that
may be available, for local plans; feasibility, screening, and implementation studies;
household hazardous waste collection events; litter enforcement initiatives; and any
other purposes that will further the purposes and goals described in this resolution;
and,
B. submit local plans to the Texas Water Commission for approval, if necessary.
2. Contingent upon the receipt of grant funds from the Texas Water Commission, or other
available sources:
A. the LCRA is authorized to hire and manage • consultants as may be necessary to
further the intents and purposes of this resolution; and,
B.
• assist the City • Georgetown in developing •• and coordinating activities in
the development of local plans and in the development and implementation of regional
solutions to integrated solid waste .•
3. As required by Chapter 363, Health & Safety Code, Comprehensive Municipal Solid Waste
Management, Resource Recovery, and Conservation Act, Sub -Chapter E, Section 363.093,
the City of Georgetown acknowledges and certifies that:
A. it will comply with the provisions • the State's Solid Waste Management plan and
the Texas Water Commission Financial Assistance Program and that it will cooperate
with
• support LCRA in its effort • achieve compliance with the state plan and
financial assistance program; and,
B. that any local solid waste management plan developed with State financial assistan
will be adopted by the City of Georgetown as its policy and thereafter solid was

management activities will, to the extent reasonabiy feasible, conform to the lo
solid waste •" plan.
The City of Georgetown agrees to consider future resolutions of interlocal agreements as
may be necessary to effectuate this resolution.
SECTION 3. This resolution shall be effective immediately upon adoption.
