VJMREAS, in January 1990, the City of Georgetown filed a petition with the TexEM
Water Commission complaining of rates charged to the City by the Brazos River Authority
water sold to the City from Lake Georgetown and Lake Stillhouse Hollow; and;
WHEREAS, the City's petition was consolidated with petitions filed by other parties
Docket 8169 -Mand; I
VaMREAS, a hearing was held at the Texas Water Commission in Docket 8169-M in
1990; and;
WHEREAS, the Brazos River Authority and the City desire to enter into a settlement
.?,greement in order to terminate the proceedings in Docket 8169-M at the Texas Water
Commission; and;
WIMREAS, it is the judgement of the City Council that a settlement of Docket 8169-M
fs in the best interest of the City-,
V4MREAS, the City Council has found that this action implements Finance DevelopmeM
Policy 1 and 2 of the Century Plan - Policy Plan Element� which states- "The City will condu
all municipal operations in an efficient business -like manner. and The City will work tow r
establishing individually self-supporting utility operations.", and I
WBEREAS, the City Council has found that this action is not inconsistent or in confli
with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapt
of the Policy Plan-, I
NOW, THEREFORE, BE IT RESOLVED BY TUE CITY COUNCIL OF THE
CITY OF GEORGETOWN, TEXAS, THAT:
The facts and recitations contained in the preamble of this resolution are hereby found a
declared to be true and correct, and are incorporated by reference herein and expressly made
part hereof, as if copied verbatim. I

SECTION 2
That the Amendment to Water Supply Contract By and Between Brazos River Authority
and City of Georgetown (for Lake Georgetown) and the Replacement Water Supply Agreement
and Between Brazos River Authoritry and Citkj, ®, Geor]4etown �for Lake Stillhouse Hollow'�,
with substituted final paragraphs to each contract, presented to the Council on September 10,
1991, by counsel for the City are hereby approved and accepted in settlement of Docket 8169-M
at the Texas Water Commission,
The Mayor is hereby authorized to execute such Amendment and Replacement
Agreement, and the City Secretary to attest thereto.
