A RESOLUTIONMAEBVGCERTAIN FINDINGS OF FACT
ANT CONCLUSIONS; AND AUTHORIZING THE HAYOR
OF THE CITY OF GEORGETOWN TO EXECUTE A QUIT
CLAIM DEED TO VACATE AND ABANDON A FIFTEEN
FOOT (IF) WIDE DRAINAGE EASEMENT LOCATED IN
LOT 4C, BLOCK A,RIVER BEND UNIT TVSUBDIVISION,
SAID EASEMENT BEING RECORDED IN VOLUNIE 11901
PAGE 314, OF THE DEED RECORDS OF WILLMISON
COIINJEXAS
WHEREAS, the City of Georgetoam has received an application for the vacation and
abandonment of fifteen foot (15') wide drainage easement located in Lot 4m; Block A, River
Bend Unit IV subdivision, said easement being recorded in Volume 1490, Page 314, of the
Official Records of Williamson County; Texas;
WHEREAS, in order for adrainageeasement to be abandoned by the City Council of
the City of Georgetown, the Council makes cerinin findings of Facts, as follows::
1. That the easement does not currently contain the storm sewer passing through the
property of convey stormwater through be property;
2, That an easement containing be storm' sewer along the west side of be property
has been dedicated to the City;
3. That there is no foreseeable use for beexist ng drainage ewment; and
That be abandonment of this easement will further the following Century Plan
Policies for Growth and Physical Development to:
a. Ensure that future land use patterns provide economic, cultural and social
a6rities to all residents, businesses, and organizations; and
b. Encourage new development and infillredevelopment;
WHEREAS, after hearing be Application and finding be specific facts as slab above,
be CityCouncil now concludes and finds that;
The fact the existing drainage improvements were constructed outside of the
easement, and that it is not economically feasible to relocate those drainage
improvements into be easement area, does constitute special circumstances and
conditions affecting the property, which if not taken into consideration, would
deprive the applicants of be reasonableuse of their property,
2. The fact that; the easement inhibits development of the property on which it is
located does provide basis for granting be use necessary for the preservation
and enjoyment of the substantial property right of the applicants;
The fact that the use of the easement area by the property owners does not
interfere with any drainage utilities or access to any unities; is not detrimental
to the public health, safety or welfare or injurious to the property m the area, and
that there exists no present or foreseeable future need for the easement, does
constitute a basis for vacating and abandoning the easement;
NOW, THEREFORE, BE TF RESOLVED BY THE CITY COUNCIL OF THE CITY
OF GEORGETOWN, that:
SECTION I.
The Mayor is hereby authorized to execute, on behalf of the City of Georgetown, aQuit
Claim Deed to L;T. Parker, vacating and abandoning of fifteen foot (IS') wide drainage
easement located inLot 4-c, Block A, River Bend Unit IV subdivision, said easement; illustrated
in Exhibit A, being recorded in Volume 1490, Page 314, of the Official Records of Williamson
County, Texas;
SECTION 11.
This resolution shall be effective immediately upon adoption,
