WHEREAS, Lower Colorado River Authority, known hereafter as "LORA", has
filed for an electric rate increase with the Public Utilities Commission; and
WHEREAS, the City of Bastrop, Texas has filed with the Public Utilities
Commission as an Intervenor in the LCRA Electric Rate Increase Case for the
purpose of effectively representing the interests of their electric utility
customers, and has retained Don Butler of Butler & Casstevens as an Attorney and
Jack Pous of Diversified Utilities, Inc. as a Rate Consultant; and
WHEREAS, the City of Georgetown, in its desire to keep reasonable electric
rates for its customers and citizens, desires to join the City of Bastrop in its
intervention under the terms and conditions set forth below;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF GEORGETOWN, TEXAS THAT:
SECTION 1. The Council adopts the recitals set forth above as true and correct
and are incorporated herein, verbatim.
SECTION 2. The City of Georgetown requests the City of Bastrop to name the
City of Georgetown on its list of Intervenors. In consideration as
being listed as an Intervenor, the City of Georgetown will make
available, upon reasonable notice, appropriate City Staff Members
and elected City Officials for testimonial purposes and for
attendances at meetings, when reasonably necessary to facilitate
this Intervention.
SECTION 3. This Resolution is conditioned on the City of Bastrop timely
providing sufficient information as to the status of the case and
advising the City, by notifying the City Manager-, of all
correspondence, meetings and hearings pertaining to this
Intervention.
SECTION 4. The City of Georgetown, through its City Manager, shall also
provide input and direction to the City of Bastrop regarding this
Intervention; however, the City of Georgetown recognizes that the
City of Bastrop retains the right of any final decision in this
Intervention.
SECTION 5. As a condition of this Resolution, the City of Georgetown requires
the City of Bastrop, as Intervenor, to request the Public Utilities
Commission (PUC) to surcharge all of the 12.5 KV class customers on
an equitable basis for the cost of the Intervention. If the City
of Bastrop is unsuccessful in this request, the City of Bastrop
shall then request the PUC to surcharge all of the Intervenors on
an equitable basis, and the City of Bastrop shall take all
necessary steps to achieve this result.
SECTION 6: The City of Georgetown retains the right to withdraw from this
Intervention at any time by official action of the City Council,
City of Georgetown, Texas.
SECTION 7: If the City of Bastrop is unsuccessful in Section 5 above, the City
of Georgetown agrees to pay its pro -rata share of the Intervention
in an amount not to exceed $ 5,000.00. If the City of Georgetown
withdraws from the Intervention, the City of Georgetown shall be
responsible only for its pro -rata costs up and until withdrawal.
SECTION 8: This Resolution shall become effective upon its acceptance by the
RESOLVED THIS Z& -A DAY OF R-- 1989.
