SUBJECT: Resolution for Emergency Assistance
DATE: June 26, 1989
MUMMM,
Enclosed is a resolution that authorizes the City to respond to
requests for emergency assistance. Although it is derived from
the interlocal "agreement" statute, art. 4413(32c) , it allows the
City to respond to requests absent an agreement4 A passage of
this resolution will enable the City to make timely responses to
situations such as the Jarrell tornado with available assistance.
You will note this resolution does not include law enforcement
assistance. This type of assistance is not allowed under this
particular law; however, it is permissible to establish mutual
aid agreements with other entities for that service. It appears
that the rationale • is the nature of law enforcement
assistance is bett . :er.served through a more controlled mechanism.
