HomeMy WebLinkAboutRES 890288 - Auth Emergency Assist Local GovRESOLUTION NO. RESOLUTION AUTHORIZING EMERGENCY ASSISTANCE Tj OTHER LOCAL GOVERNMENTS. WHEREAS, art. 4413(32c) of Tex. Rev. Civ. Stat. Ann. allows governing bodies to offer emergency assistance in civil emergencies to other governments when a resolution is passed by the assisting body; and WHEREAS, the City of Georgetown wishes to provide timely assistance of governmental services in the event of a disaster to other communities, who may require such assistance; and WHEREAS, the Council recognizes it 'is precluded from providing law enforcement services as part of this resolution; and WHEREAS, the City Council wishes to pass a resolution in order to effectively and timely offer its assistance in civil emergencies; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, that: • The City Council finds that the recitals set forth above are true and correct and are adopted herein verbatim as if fully set forth at lenqth. SECTION II. That the City of Georgetown is hereby authorized to provide emergency assistance in the form of governmental services as provided by sec. 3 of art, 4413 (32c) of Tex. Rev. Civ. Stat. Ann., excluding law enforcement servicesl for civil emergencies to other local governments when, in the opinion of the presiding officer of that local governmental body, an emergency exists and the presiding officer has requested assistance. - These services will be made available when, in the decision of the City Manager, they are not presently needed gor the City of Georgetown. Although it is derived from the interlocal "agreement" statute, art. 4413(32c) , it allows the City to respond to requests absent an agreement4 A passage of this resolution will enable the City to make timely responses to situations such as the Jarrell tornado with available assistance. You will note this resolution does not include law enforcement assistance. This type of assistance is not allowed under this particular law; however, it is permissible to establish mutual aid agreements with other entities for that service.
