HomeMy WebLinkAboutRES 890311 - Auth Acquisition Clear ZoneRESOLUTION NO. 81-1o311 I A RESOLUTION AUTHORIZING THE CITY STAFF_M,_1C_T9'T ATTORNEY TO PROCEED WITH THE ACQUISITION OF THE CLEAR ZONE TO RUNWAY 29. WHEREAS, the City Council of the City of Georgetown, Texas, Rcting on recommendations of the Federal Aviation Administration (FAA) finds that the Clear Zone at the end of Runway 29 is insufficient for the safety of Airport users; and, WHEREAS, the Council finds that the acquisition of the property in said Clear Zone is an advisable municipal purpose to accommodate the safety needs of Airport users; and, WHEREAS, there exists private property adjacent to the Airport that can accommodate this Clear Zone need; and, WHEREAS, the City of Georgetown, Texas, desires to purchase this 1wrivate property in the Clear Zone to Runway 29; or, in the event a 1@urchase is not possible, the City desires to acquire this property through statutory eminent domain proceedings, and, WHEREAS, the Council has found that this action implements Facilities and Services Policy I of the Century Plan -Policy Plan Element, and is not found to be inconsistent, nor in conflictt with any other Century Plan Policies, as required by Section 2.08 of the Administrative Chapter of the Policy Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS; The Council finds that the recitals set forth above are true and correct and are incorporated herein for all purposes. The Council authorizes the City Staff and City Attorney to proceed with the acquisition of the property located and described as follows: By fee simple 4.51 acres of David Wright Survey, abstract No. 13i Williamson County, Texas (northwest corner of Lakeway Drive and Airport Road), Volume 9581 page 371, and Volume 928, page 625, Williamson County Deed Records. If the property may be acquired from the owner for the amount of the funds authorized to be expended by the FAA, the Council authorizes the Mayor to execute instruments of conveyance on behalf of the City of Georgetown as grantee for the .is ve-d68cribed property. W-5147MIUM In the event FAA -approved authorized expenditures are not acceptable to the owner of the above-described property, the City Attorney is authorized to seek approval for an Administrative Settlement from the FAA to allow an increase in the authorized level of expenditure for the property, and that the Mayor be authorized to execute instruments of conveyance on behalf of the City of Georgetown as grantee for the property. In the event the purchase of the property is not accomplished through reasonable ftegotiationst theft the City Attorney is directed to proceed with condemnation proceedings for the purpose of acquisition of the property for the Clear Zone at the Georgetown Municipal Airport.
