RESOLUTION
WHEREAS, the City Council of the City of Georgetown acting on
recommendations of the Federal Aviation Administration (FAA) finds
availability of clear zones at the end of runway 36 and 11 and 29 are
insufficient for the safety of airport users; and
WHEREAS, the City Council finds that the acquisition of property
for clear zones is an advisable municipal purpose to accommodate the
safety needs of airport users; and
WHEREAS, there exists private property adjacent to the airport
that can accommodate those clear zones needs; and
WHEREAS, the City of Georgetown desires to purchase those private
properties or acquire avigation easements above those private properties
for use as clear zones at the airport. In the event a purchase is not
possible, the City of Georgetown desires to acquire those properties, in
fee simple and avigation easement, through statutory eminent domain
proceedings; NOW THEREFORE,

SECTION I: That the City Council adopts the above findings as true and
correct and authorizes the City Staff and City Attorney to proceed with
the acquisition of the properties described below to accomplish the
purposes of this resolution. These properties are located and described
as follows:
1. By fee simple 9.94 acres of David Wright Survey, abstract
No. 13, Williamson Co., Texas (North side of Lakeway
Drive approximately .6 miles west of Airport Road.)
Volume 1216, page 269 Williamson County Deed Records.
2. By avigation easement 5.84 acres David Wright, abstract
No. 13, Williamson County, Texas (Northwest corner of
Georgetown Municipal Airport near the intersection of
Serenada Drive and proposed extension of Northwest
Boulevard.) Volume 583, page 803 Williamson County Deed
Records.
3. By avigation easement 4.51 acres David Wright Survey,
abstract No. 13, Williamson County, Texas (Northwest
corner of Lakeway Drive and Airport Road.) Volume 958,
page 371 and Volume 928, page 625 Williamson County Deed
Records.
SECTION II: If the properties may be acquired from the owners for the
amount of the funds authorized to be expended by the Federal Aviation
Administration, that the Mayor be authorized to execute instruments of
conveyance on behalf of the City of Georgetown as grantee for the above
properties.
SECTION III: In the event FAA approved authorized expenditures are not
acceptable to any of the owners of the above properties, the City
Attorney is authorized to seek approval for an Administrative settlement
from the FAA to allow an increase in the authorized level of expenditure
for the properties and that the Mayor be authorized to execute
instruments of conveyance on behalf of the City of Georgetown as grantee
for the properties.
SECTION IV: In the event the purchase of the properties is not
accomplished through reasonable negotiations, then the City Attorney is
directed to proceed with condemnation proceedings for the purpose of
acquisition of the properties for clear zones at the Georgetown
Municipal Airport.
