A RESOLUTION WAIVING CAPITAL RECOVERY FEES
FOR TWO WATER METERS SERVING LANDSCAPE
IRRIGATION IN THE RIGHT-OF-WAY OF IH -35 AT
FM2338; LIMITING USE OF SUBJECT METERS; AND
PROVIDING FOR PAYMENT OF WATER CONNECT FEES
AND WATER CONSUMPTION BILLSo
WHEREAS, the State Department of Highways and Public
Transportation ("the Department") proposes to install decorative
landscaping within the right-of-way of IH -35 at its intersection
with FM2338 in Georgetown; and
WHEREAS, the City Council desires to cooperate in the
enhancement of the City's major thoroughfares by the provision of
landscape improvements such as those proposed by the Department;
and
WHEREAS, the Department has requested that the City Council
waive Capital Recovery Fees for two water meters which will be
required to serve the Department's landscape irrigation system;
and
WHEREAS, the City Council finds that the water consumption
characteristics of the proposed landscape irrigation system will
not pose significant demands on the City's water treatment and
distribution systems, and that the irrigation system will not be
utilized on a permanent, long-term basis;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Georgetown, Texas that:
1. The assessment and collection of Capital Recovery Fees
for two (2) one and one half inch water meters requested
to serve the landscape irrigation at the intersection of
IH -35 and FM2338 are hereby waived.
2. Any use of the water meters subject to the waiver granted
under Section I other than for service of landscape
irrigation shall require the payment of Capital Recovery
Fees in effect at the time of such change of use.
3. Payment of water connect fees ("tap fees") as established
by ordinance shall be required prior to the installation
of the subject water meters. Billing by the City for
water consumed by the Department shall be in accordance
with water rates established by ordinance.
