HomeMy WebLinkAboutRES 880399 - Waive Recovery Fees Meter WeirRESOLUTION A RESOLUTION WAIVING CAPITAL RECOVERY FEES FOR A WATER METER SERVING THE WEIR RANCH PARTNERSHIP; LIMITING USE OF SUBJECT METER; AND PROVIDING FOR PAYMENT OF WATER CONNECT FEES AND WATER COSUMPTION BILLS. WHEREAS, the Weir Ranch Partnership proposes to continue agricultural production of livestock cattle; and WHEREAS, the City Council desires to cooperate in the promotion of existing businesses within the City of Georgetown; and WHEREAS, the Weir Ranch Partnership has requested that the City Council waive the Capital Recovery Fees for one water meter installation which will be required to serve the agricultural production needs of the partnership; and WHEREAS, the City finds that the water consumption characteristics of the proposed agricultural installation will not pose significant demands on the City's water treatment and distribution needs, and that the installation will meet all other applicable codes, ordinances, and requirements as set forth by the City; NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Georgetown, Texas that: 1. The assessment and collection of Capital Recovery Fees for one (1) 3/4 inch water meter requested to serve the Weir Ranch Partnership, located a ' djacent to and West of River View Estates are hereby waived. 2. Any use of the water meter subject to the waiver granted under Section 1 other than for service of Agricultural use shall require the payment of Capital Recovery Fees in effect at the time of such change of use. 3. Payment of water connect fees ("tap fees") as established by ordinance shall be required prior to the installation of the subject water meter. Billing by the City for water consumed by the Weir Ranch Partnership at this location shall be in accordance with water rates established by ordinance. Tim KenneZty-, Mayor City of Georgetown Leta--WH-loughby City Secretary Dian�e Calla6der City Attorney CITY OF GEORGETOWN MEMORANDUM TO: Mayor, City Council, City Manager FROM: Jim Briggs 4-P Director of Public Utilities RE: Wavier of Capital Recovery Fees for Weir Ranch Partnerships Public Utilities has received a request from Mrs. Ester Weir, of Weir Ranch Partnership, for installation of a 3/4 inch water tap in River View Sub -Division. This request was made, from the Weir Ranch Partnership, specifically due to the continued lack of rain this area has received over the course of 1988. The nature of the business of Weir Ranchs' business is specifically limited to agricultural and more specifically to ranching. Mrs. Weir conveyed to me that in the past her water, used for penning cattle, specifically came from the South San Gabriel River. During the last two months, an asphalt producing plant located on the South San Gabriel River has also began buying bulk water. Since the use of this water, for Mrs. Weirs' purpose, would be on a seasonal basis she has requested that the City waive the Capital Recovery Fee of $1,500.00. Mrs. Weir has further agreed that all tap fees and other use fees will be payed by the Weir Ranch Partnership for this meter. The City staff has in the interim made temporary arrangements through a fire hydrant construction meter for the Weir Ranch Partnership to get some interim relief. Because of the nature of this request, and that it will be specifically limited to agricultural use, the staff is recommending the wavier of Capital Recovery Fees to Weir Ranch Partnership in the amount of $1,500.00. This is contingent upon the fact that all other fees be paid and that this tap be specifically limited to agricultural use only. Proposed Motion: See attached resolution . JB/plw A. C.
