HomeMy WebLinkAboutRES 870237.001 - Payment for DamagesI WHEREAS, the City of Georgetown, like all other Texas Municipalities, engages in certain governmental functions that affect the public in general and are performed pursuant to powers conferred on the city as an agency of the state, subject to state control, and WHEREAS, the Texas Tort Claims Act has held that since municipalities are required to perform such governmental functions that municipalities shall not be held liable for damages sustained by citizens unless there is gross negligence on the part of the municipality in performing them, and WHEREAS, the City of Georgetown's insurance carrier will not pay any claims that result from the conduct of required governmental functions, and WHEREAS, the City Council in order to spare the taxpayers of Georgetown the expense for such damages, the Council adopts a policy of nonpayment of them unless it determines there are extenuating circumstances, therefore; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, that the City Council adopt the following policy: The City of Georgetown shall not compensate anyone for damages incurred as a result of performing a required governmental function unless the Council determines there are extenuating circumstances.
