AND
ADDITION OF PROPERTY TO
GEORGETOWN PUBLIC IMPROVEMENT DISTRICT NO.1
TO THE CITY OF GEORGETOWN, TEXAS:
The undersigned (hereinafter the "Petitioner"), being the entity which holds fee simple title to
more than fifty percent (50%) of the appraised value of taxable property proposed to be
included within the public improvement district proposed in this petition (the "Petition"), with
the intention to further the development of the land hereinafter described, and to benefit the
City of Georgetown acting pursuant to the provisions of Subchapter C, Chapter 372, Local
Government Code, hereby respectfully petitions the City of Georgetown, Texas (the "City"),
requesting the addition of property to and the amendment of the agreements concerning and
governing an existing Subchapter C public improvement district, known as Georgetown Public
Improvement District No. 1 (the "District') on the terms and for the purposes stated below:
1. PETITIONER: GREEN BUILDERS, INC.
2. PURPOSE: To add the property described below (the "Additional Property") to the
boundaries of the District.
To amendment the Georgetown Public Improvement Assessment District
Assessment/Service Plan as set forth below to make the Additional
Property subject to the assessments, liens and obligations of the District.
3. SYNOPSIS: Georgetown Public Improvement District No. 1 was approved by the City
Council on. February.23, 1999, pursuant to Chapter 372 of the Local
Government Code and Resolution No. 990223-N, and adopted the
Georgetown Public Improvement Assessment District
Assessment/Service Plan by Ordinance No. 99-22 effective April 27,
1999. At the time, a portion of the development known as Georgetown
Village was included in the District. Petitioner, the present owner of the
remainder of the development known as Georgetown Village desires to
have additional properties included in the District and to have the
Assessment/Service Plan additionally encumber and apply to the
Additional Property described on Exhibit A attached hereto.
4. CODE: In accordance with Chapter 372, Local Government Code, Petitioner
hereby respectfully shows the City as follows:
a. GENERAL NATURE OF THE PROPOSED
IMPROVEMENTS. The acquisition, construction, operation,
repair and maintenance of parks, recreational facilities,
alleyways, lighting., landscaping and related improvements
in accordance with the existing Assessment/Service Plan.
b. ESTIMATED COST OF THE IMPROVEMENTS. The
estimated cost of new improvements to be added to the
Assessment/Service Plan is $10,488,971.00.
c. BOUNDARIES OF THE PROPOSED ASSESSMENT
DISTRICT. The new boundaries would include all existing
property and would add thereto the boundaries of the property
described on Exhibit A attached hereto. The Assessment/Service
Plan and all existing ordinances fixing liens and assessments
would be amended to include the Additional Property, which
would then be subject to all assessments, liens and obligations
equivalent to all existing property.
d. PROPOSED METHOD OF ASSESSMENT. A Maintenance
Assessment, as described in the existing approved
Assessment/Service Plan, based on the annual, assessed
value of each lot, including improvements, is fair and
equitable and is the most reasonable means of
allocating the costs of the services to be provided
annually on behalf of the District. Additionally, a one-
time assessment of -$1,000 per lot, as a Capital
Improvement Assessment, is fair and equitable and is the
most reasonable means of allocating the costs of capital
improvements. All such costs are born by the District.
The City shall not be responsible for any District costs.
e. MANAGEMENT. The District, as amended and
property added would continue to be governed by the
District board as presently constituted, created and
approved.
The petitioner, as the owner of all of the Additional Property, has requested and
concurred, and does hereby request and concur with the establishment of the district and
the amendments and additions stated herein, and certifies that Petitioner holds fee simple title to
more than fifty percent (50%) of the appraised value of taxable property constituting the
Additional Property.
The Petitioner further requests that notice be issued and hearings set, scheduled and held in
accordance with Chapter 372, Local Government Code and the ordinances and regulations of
the City of Georgetown, and that upon hearing all of the foregoing matters be approved, the
Additional Property be included in the boundaries of the PID, the Assessment/Service Plan and
all PID ordinances be applicable to the Additional Property, and Petitioner receive such other
actions, approvals, consents and undertakings as shall be consistent with Chapter 372, Local
Government Code and the ordinances and regulations of the City of Georgetown.
