HomeMy WebLinkAboutRES 061317-G - 15' ROW Abandon EsmtRESOLUTION NO. 0(0`3 C1 ` 6� RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN VACATING AND ABANDONING PORTIONS OF A 15 -FOOT RIGHT OF WAY EASEMENT OUT OF THE WILLIAM ROBERTS SURVEY, ABSTRACT 524, NOW PART OF THE BERRY CREEK SUBDIVISION SECTION FIVE, PHASE TWO, A SUBDIVISION RECORDED AS DOCUMENT NO. 2014013881 OF THE PLAT RECORDS OF WILLIAMSON COUNTY, TEXAS (THE "EASEMENT"), AND BEING LOCATED UNDER AND ALONG KINGSWAY ROAD, AND ACROSS ADJACENT LOTS, BETWEEN OWL CREEK AND ANIKA COVE. WHEREAS, the City of Georgetown has received a request for the vacation and abandonment of portions of the above-described Easement, due to the crossing of several lots adjacent to Kingsway Road which prevents these lots from being built upon; and WHEREAS, the City of Georgetown ("City") has received a request from KB Home Lonestar, Inc., the current owner of property encumbered by the above-described easement. The encumbrance of Lot 39, Block C, Lots 21 & 22, Block E, and Lots 17 & 18, Block F by the Easement leaves insufficient room for construction of a new homes and prevents development of the lot. The portions of the Easement requested to be abandoned and vacated are fully described by metes and bounds and sketch on Exhibits "A", "B", "C "D" & "E" attached hereto (the "Property"); and WHEREAS, the dedication of Kingsway Road and adjoining roadways as public rights- of-way provides the same or similar access which was the purpose of the Easement; and WHEREAS, upon considering the request for vacation and abandonment of the subject portions of the Easement and additional information pertaining to the request, the City Council finds that a public need for the areas sought to be vacated and abandoned no longer exists and that said portions of the Easement may be vacated and abandoned pursuant to City Ordinance No. 2009-47 relating to disposition of City property; and WHEREAS, nothing herein shall operate to vacate or abandon the remainder of said Easement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that the Resolution No. QU%31`L . SECTION 2. The Mayor is hereby authorized to execute a Quitclaim Deed in substantially the same form attached hereto as Exhibit "F" and any other conveyance document(s) necessary to complete the vacation and abandonment of the portions of the Easement described herein and the City Secretary is authorized to attest thereto on behalf of the City of Georgetown. SECTION 3. This resolution shall be effective immediately upon adoption.
