HomeMy WebLinkAboutRES 09.08.1975 - Block Grants14 A RESOLUTION RECOGNIZING ENACTMENT OF FEDERAL AND STATE LAWS WHICH REGULATE COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAMS AND ESTABLISHING CERTAIN RULES PROCEDURES AND A CITIZENS PARTI- CIPATION PLAN FOR THE GEORGETOWN TEXAS 1976 COMMUNITY DEVELOP- MENT PROGRAM WHEREAS the Senate and House of Representatives of the United States of America did enact and the President sign into law the Housing and Community Development Act of 1974 and WHEREAS the Sanate and House of Representatives of the State of Texas did enact and the Governor sign into law the Texas Community Development Act of 1975 and WHEREAS both the Federal and State Laws require that municipalities implementing a Community Development Program as provided for and by the Federal and State Laws must inter alfa establish and make public a plan under which citizens may publicly participate in and comment on the proposed Community Development Program THEREFORE BE IT RESOLVED that the Mayor and City Council of the City of George- town Texas do hereby declare that the following Citizens Participation Plan for the 1976 Georgetown Texas Community Development Program is established and made avail able to any citizen of the City of Georgetown Texas who requests a copy of the plan and that each member of the Citizens Advisory Commission Planning and Zoning Commission and Council member be furnished a copy for their direction and guidance TO WI T CITY OF GEORGETOWN CITIZENS PARTICIPATION PLAN PROGRAM YEAR 1976 References 1) Housing and Community Development Act of 1974 Title 1 2) Texas Community Development Act of 1975 SB No 734 Section 5 (b) (c) PURPOSE OF PLAN 1 To provide a local process which permits citizens likely to be affected by commun- ity development and housing activities including low and moderate income persons to articulate needs express preferences about proposed activities, assist in the selection of priorities and otherwise participate in the development of the application (for Community Development hereinafter called C D ) funds and have individual and other complaints answered in a timely and responsive manner HOW CITIZENS WILL PARTICIPATE 2 Citizens participation for C D planning will be primarily through the established Citizens Advisory Commission which consists of persons representative of all citizens of Georgetown including low and moderate income persons likely to be affected by community development and housing activities 1 3 The Citizens Advisory Commission working with individuals and such ad hoc citizens groups as may be formed to study specific community development needs will develop inputs and guidance to city planners at appropriate times during the programming cycle and develop a final position statement on each year s program and plan 2 1 See Attachment 1 - Citizens Advisory Commission Membership 2 See Attachment 2 - Housing and Community Development Planning Schedule 1976 Fund Year 4 The final position statement along with all individual comments made at public hearings and meetings conducted as prescribed by City Ordinance shall be recorded and made a part of the administrative record of the Citizens Advisory Commission These records shall reflect where and when meetings were held who attended a summary of conclusions findings and recommendations and a minority report if a consensus cannot be reached Records shall be subject to public examination at any reasonable time and extracts and certified copies will be required for the annual performance report to HUD Such state- ment should be completed by January 12 1976 Public Hearing 15 HOW LOCAL GOVERNMENT WILL ASSIST CITIZENS 5 A public hearing was held on July 29 1975 The purpose of the meeting among other things was to provide general information about the Community Development Block Grant program the amount of funds available and other program requirements including the responsibilities of local government and citizens participation Hold harmless funds identified for Georgetown Texas are as follows FY 1975 - $228 000 FY 1976 - $228 000 FY 1977 - $228 000 FY 1978 - $152 000 FY 1979 - $ 76 000 6 During the public hearing on July 29 1975 the 1976 planning schedule was established based on deadline dates required by HUD for submitting an application for grant funds under the Act considering all presubmission certification and coordination requirements (See Attachment 2) 7 If after Program approval and submission it becomes necessary to amend the 1976 application reprogram 1976 funds or designate new activities or locations a reprogramming planning schedule will be established and made a matter of public notice and records Inputs N guidance and coordination will be requested from the Citizens Advisory Commission on all r., program amendment actions cl' 8 In addition to the general technical briefing on provisions of the 1975 C D Act at the July 29 1975 meeting the Mayor City Council City Manager and his Planning Staff and the City Attorney will provide assistance to the Citizens Advisory Commission and any interested citizens concerning provisions of the 1974 C D Act including such requirements as Davis -Bacon environmental policies equal opportunity requirements relocation provisions and like requirements Such assistance will be provided when requested and throughout the planning cycle to insure legal compliance with the 1974 C D Act State and Local law WHEN AND WHERE CITIZENS WILL PARTICIPATE 9 Citizens participation started with the July 29 1975 public hearing held in the City Council Chamber City Hall at 7 00 p m A letter of invitation was addressedto all members of the City Council Planning and Zoning Commission Citizens Advisory Commission and All Other Citizens of the City of Georgetown on July 21 1975 In addition public notice appeared in the local newspaper for the period required by local ordinance for a public hearing 10 The Citizens Advisory Commission will schedule additional public meetings as necessary prior to January 12 1976 to review work previously completed in establishing the workable program goals projects and priorities including work done for the 1975 C D program and develop a written statement as indicated by paragraph 4 above by January 12 1976 The Citizens Advisory Commission should recognize that the final decision for program direction rests with the elected city officials for they are responsible both to every citizen and to the Federal and State authorities for stewardship of grant aid funds 11 After all local level planning coordination and public hearings have been completed the CD Program and application will be considered at a special City Council Meeting to be held on January 27 1976 to act on an approving resolution The date of this meeting is 15 days after the lost scheduled public hearing on the 1976 CD Program as required by Section 5 paragraph (c) of the Texas Community Development Act of 1975 PASSED AND APPROVED this 8th day of September 1975 ATTEST Joe B McMaster City Attorney 16 ATTACHMENT i GEORGETOWN CITIZENS ADVISORY COMMISSION 1 C A Forbes Chairman -
