HomeMy WebLinkAboutRES 082217-K - Abandon Montgomery StRESOLUTION NO. d$a 0 --1� RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN VACATING AND ABANDONING A 15 -FOOT WIDE PORTION OF A RIGHT OF WAY, KNOWN AS MONTGOMERY STREET, OUT OF THE RUCKER AND HODGES ADDITION, AN ADDITION TO THE CITY OF GEORGETOWN RECORDED IN VOLUME 15, PAGE 190 OF THE DEED RECORDS OF WILLIAMSON COUNTY, TEXAS (THE "ROW"), AND BEING LOCATED NORTH OF 10TH STREET AND EAST OF THE INTERSECTION OF 10TH STREET AND SCENIC DRIVE IN GEORGETOWN, TEXAS. WHEREAS, the City of Georgetown has received a request for the vacation and abandonment of a portion of the above-described ROW, known as Montgomery Street, to allow for its inclusion into an adjoining lot; and WHEREAS, the City of Georgetown ("City") has received a request from Robert C. Easter, Sr. and Carolyn Easter., the current owners of property adjacent to the above described ROW. The west half of this ROW has been abandoned to the opposite property owner. A portion of the east half of the ROW was abandoned to Genaro Ramos, previous owner of the property now held by Mr. & Mrs. Easter. The previous abandonments have rendered the remaining ROW of no use as a public right-of-way. The ROW requested to be abandoned and vacated is described by the metes and bounds with sketch on Exhibit "A" attached hereto (the "Property"); and WHEREAS, upon considering the request for vacation and abandonment of the subject portions of the ROW and additional information pertaining to the request, the City Council finds that a public need for the areas sought to be vacated and abandoned no longer exists and that said portions of the ROW may be vacated and abandoned pursuant to City Ordinance No. 2009- 47 relating to disposition of City property; and ROW. WHEREAS, nothing herein shall operate to vacate or abandon the remainder of said NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that the adoption of this resolution is not inconsistent or in conflict with any of the City's 2030 Comprehensive Plan policies. The Mayor is hereby authorized to execute a Quitclaim Deed in substantially the same form attached hereto as Exhibit "B" and any other conveyance document(s) necessary to complete the vacation and abandonment of the portions of the PUE described herein and the City Secretary is authorized to attest thereto on behalf of the City of Georgetown. Surveyed on the ground in the month of April, 2014, under the supervision of Brian F.
