RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN
VACATING AND ABANDONING PORTIONS OF TWO 10 -FOOT WIDE
PUBLIC UTILITY EASEMENTS (PLIES) ACROSS LOT 11, BLOCK D,
SERENADA WEST, SECTION TWO, A SUBDIVISION OF WILLIAMSON
COUNTY, TEXAS RECORDED AS CABINET D, SLIDE 130-134 OF THE PLAT
RECORDS OF WILLIAMSON COUNTY, TEXAS.
WHEREAS, the City of Georgetown has received a request for the vacation and
abandonment of portions of two 10' PUEs, which bisect a lot; and
WHEREAS, the City of Georgetown ("City") has received a request from the current
owners of the property to abandon the portions of the PUEs. An accessory building has been
constructed, encroaching no less than 4.4 feet into one easement and 2.4 feet into another, for a
total of 294.3 square feet. The subject PUEs are not in use nor planned for use by any of the area
utility providers. The portion of the PUEs requested to be abandoned and vacated is described
by the metes and bounds with sketch on Exhibit "A" attached hereto (the "Property"); and
WHEREAS, upon considering the request for vacation and abandonment of the subject
PUEs and additional information pertaining to the request, the City Council finds that a public
need for the areas sought to be vacated and abandoned no longer exists and that said portions of
the PUEs may be vacated and abandoned pursuant to City Ordinance No. 2009-47 relating to
disposition of City property; and
WHEREAS, nothing herein shall operate to vacate or abandon the remainder of said
ROW.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS, THAT:
SECTION 1. The facts and recitations contained in the preamble of this resolution are
hereby found and declared to be true and correct, and are incorporated by reference herein and
expressly made a part hereof, as if copied verbatim. The City Council hereby finds that the
adoption of this resolution is not inconsistent or in conflict with any of the City's 2030
Comprehensive Plan policies.
SECTION 2. The Mayor is hereby authorized to execute a Quitclaim Deed in
substantially the same form attached hereto as Exhibit "B" and any other conveyance
document(s) necessary to complete the vacation and abandonment of the portions of the PUE

COMMENCING: at a 1/2" iron rod with no cap found for the northwest corner of said Lot 11, S 15°23'06"
W 186.69 feet to a 1/2" iron rod with plastic cap stamped "TLS INC" set for the southwest corner of said
Lot 11, and N 46038'13" E 10.01 feet to a calculated point, being the southwest corner of a One Story
Frame Structure, the southwest corner and the Point of Beginning for this tract;
THENCE: N 15°50'54" E 52.05 feet with the west side of said structure to a calculated point being the
northwest corner of said structure and this tract;
THENCE: S 74°09'06" E 4.39 feet with the north line of said structure to a calculated point on a 10 foot
building set back line and public utility line, for the most northerly northeast corner of this tract;
THENCE: through said structure with said 10 foot building set back line and public utility line the following
two (2) courses:
1. S 15°23'06" W 50.63 feet to a calculated point being an interior "ell" corner in the east line of this
tract,
2. S 74'1522" E at 25.60 feet crossing the east line of said structure and continuing in all 37.59 feet
to a calculated point in the east edge of a wood deck, for the most northerly southeast corner of
this tract;
THENCE: S 15°43'44" W 1.50 feet with the east edge of said deck to a calculated point being the south
east corner of said deck, for the southeast corner of this tract;
THENCE: N 74'08'11" W with the south line of said deck at 11.99 feet pass the southeast corner of said
structure, continuing 42.39 feet in all with the south line of said structure to the Point of Beginning.

For the consideration, GRANTOR quitclaims to GRANTEE all of GRANTOR'S
right, title, and interest in and to the above described property, to have and to hold it to
GRANTEE, GRANTEE'S successors and assigns, forever. Neither GRANTOR, nor
GRANTOR'S successors and assigns, shall have, claim or demand any right or title to the
property or any part of it.
