D'I l -a1-1 — G RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN VACATING AND ABANDONING A 10 -FOOT WIDE PUBLIC UTILITY EASEMENT (PUE), LOT 34A, AMENDED PLAT OF LOTS 29 AND 34, BLOCK 1, OAK CREST RANCHETTES UNIT 3, A SUBDIVISION OF WILLIAMSON COUNTY, TEXAS RECORDED AS DOCUMENT 2008068628 OF THE OFFICIAL PUBLIC RECORDS OF WILLIAMSON COUNTY, TEXAS. WHEREAS, the City of Georgetown has received a request for the vacation and abandonment of a PUE, which bisects a lot; and WHEREAS, the City of Georgetown ("City") has received a request from the current owners of the property to abandon the PUE. The PUE was once located along a common lot line. The two lots were combined in a re -plat, leaving the PUE bisecting a portion of the lot and interfering with further development. The PUE requested to be abandoned and vacated is described by the metes and bounds with sketch on Exhibit "A" attached hereto (the "Property"); and WHEREAS, upon considering the request for vacation and abandonment of the subject PUE and additional information pertaining to the request, the City Council finds that a public need for the areas sought to be vacated and abandoned no longer exists and that said portions of the ROW may be vacated and abandoned pursuant to City Ordinance No. 2009-47 relating to disposition of City property; and WHEREAS, nothing herein shall operate to vacate or abandon the remainder of said ROW. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that the adoption of this resolution is not inconsistent or in conflict with any of the City's 2030 Comprehensive Plan policies. SECTION 2. The Mayor is hereby authorized to execute a Quitclaim Deed in substantially the same form attached hereto as Exhibit "B" and any other conveyance document(s) necessary to complete the vacation and abandonment of the portions of the PUE Resolution No. 69 I -A1-1 " Cz, Description: Vacation and abandonment of a PUE, LOT 34-A, Block 1, Oak Crest Ranchettes Unit III Date Approved: 9 ll� _Ia0_t Page 1 of 2 described herein and the City Secretary is authorized to attest thereto on behalf of the City of Georgetown.
