A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, PURSUANT TO THE CODE OF ORDINANCES OF GEORGETOWN, TEXAS, RECOMMENDING INITIATION OF AN EXECUTIVE AMENDMENT TO THE UNIFIED DEVELOPMENT CODE RELATIVE TO THE MINIMUM DISTRICT SIZE REQUIREMENT OF THE BUSINESS PARK (BP) ZONING DISTRICT; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, on March 11, 2003, the City Council of the City of Georgetown, Texas, adopted a set of comprehensive development regulations known as the Unified Development Code ("UDC') via Ordinance No. 2003-16, which codified various zoning and subdivision standards; and WHEREAS, the 2003 UDC established minimum lot size standards for the Business Park ('BP") zoning district of five (5) acres; and WHEREAS, this provision was later amended in 2009 via Ordinance No. 2009-56 to remove the minimum lot size standard and include provisions for a minimum district size of twenty (20) acres for the BP zoning district in order to allow limited complementary uses that may expand with the size of the park; and WHEREAS, the current minimum district size has presented challenges in certain areas where the BP zoning may be appropriate by inadvertently affecting the minimum lot area needed to develop a business park on a single property; and WHEREAS, the City is in receipt of a request to amend the UDC to revise the minimum district size requirement from twenty (20) acres to five (5) acres in order to provide the opportunity to build job -creating business park projects on properties that are five (5) acres or more; and WHEREAS, the City Council established a Unified Development Code Advisory Committee on November 12, 2013, to review proposed or requested amendments to the UDC other than executive amendments, which are those amendments that are nondiscretionary, mandatory, or legislative revisions to address state statutes or case laws, ratify published directors determinations, incorporate recently approved Council ordinances, process City Council designated emergency items, or address revisions otherwise determined necessary by legal counsel. Oa.a`] 1 PAGE 1 OF 2 BP MINIMUM ZONING DISTRICT SIZE NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1: The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this resolution implements the City of Georgetown 2030 Comprehensive Plan. SECTION 2: City Council hereby designates amendments to the UDC relative to the minimum district size requirement for the BP zoning district as an executive amendment to address revisions determined necessary by legal counsel. SECTION 3: The Mayor is hereby authorized to execute, and the City Secretary to attest this Resolution. SECTION 4: This resolution shall become effective immediately upon adoption.
