RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN AUTHORIZING THE VACATION AND ABANDONMENT OF EASEMENT RIGHTS TO A 3.488 ACRE, 0.274 ACRE AND 0.278 ACRE TRACTS OF LAND MORE OR LESS, OUT OF THE JOSEPH P. PULSIFER SURVEY, AND BEING LOCATED ALONG THE WEST LINE OF WOLF RANCH PARKWAY. WHEREAS, the City of Georgetown has received a request to abandon easement rights to those 3.488 acre and 0.274 acre tracts of land on the terms of that certain agreement recorded as Document No. 2005082793 of the Official Public Records of Williamson County, Texas; as well as the abandonment of easement rights to that certain 0.278 acre tract described in Document 2005082792 of the Official Public Records of Williamson County, Texas; WHERESAS, said 3.488 acre and 0.274 acre tracts are more fully described in Document No. 2005082793, and said 0.278 acre tract is more fully described in Document 2005082792, of the Official Public Records of Williamson County, Texas (collectively, the "Property"); and WHEREAS, the Property was acquired in 2005 as part of the extension of a roadway now known as Wolf Ranch Parkway for the purposes of treatment and conveyance of storm water from the roadway; and WHEREAS, under the terms of the drainage easement recorded as Document No. 2005082793 the easements and improvements were to be returned to the owner of the land upon private development in the drainage basin; and WHEREAS, the H4 WR, LP. (the applicant) is holder of the underlying fee estate of the Property and has undertaken such development, and now requests the release and return of the Property and improvements; and, WHEREAS, the above mentioned access easement will no longer be necessary upon release of the drainage infrastructure; and, WHEREAS, in return for the abandonment of the Property and as part of their development, the applicant is improving the drainage infrastructure and has agreed to grant the necessary easements to allow the City to continue to use the pond and related infrastructure; and, WHEREAS, upon considering the request for vacation and abandonment of the Property and additional information pertaining to the request, the City Council finds that a public need for the Property no longer exists, and that such Property may then be vacated and abandoned; and WHEREAS, the City Manager, or his designee, has reviewed this request and has no Resolution No. 0`5051 $ - D Description: Corner {SOW, NE Inner Loop and Austin Ave Date Approved: 5 l s k 3L6 $ Page 1 of 2 objection to the vacation and abandonment of the Property, subject to the conditions described herein. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that the adoption of this resolution is not inconsistent or in conflict with any of the City's 2030 Comprehensive Plan policies. SECTION 2. The Mayor is hereby authorized to execute a Quitclaim Deed in substantially the same form attached hereto as Exhibit "A", and any other conveyance document(s) necessary to complete the vacation and abandonment of the Property described herein, and the City Secretary is authorized to attest thereto on behalf of the City of Georgetown, subject to receipt of payment.
