A RESOLUTION AUTHORIZING

WHEREAS, Article 4413
(320), Texas Civil Statutes authorises
municipalities to enter into a �.
greements rich neighboring
municipalities for the purpose of providing mutual aid in the area
of fire protection, and
.WHEREAS, the Round Rock City Council desires to enter into such
an agreement with the City of Georgetown, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS
That the Mayor is hereby authorised and directed to execute on
behalf of the City a Mutual Aid Fire Protection Agreement with the
City of Georgetown, a copy of said agreement being attached hereto
and incorporated herein for all purposes.

act by ordinance or resolution duly passed by said Cities.
WITNESSETH:
WHEREAS, Article 44U (32c), TEXAS.REV.CIV.STAT,ANN., authorizes a county of
municipality by resolution of.its governing body to enter into an agreement
with any neighboring municipality or contiguous county for the purpose of
providing mutual aid in the areas of fire protection, and
WHEREAS, the Cities of Georgetown and Round Rock in Williamson County desire
to enter into such a mutual aid fire protection agreement wherein the equipment,
facilities and trained personnel of each fire department is available to the
other participant in the mutual aid agreement on an as requested basis;
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS: That in consideration of the
mutual covenants, agreements and benefits to all parties, it is AGREED as

follows:
I.
During the term of this agreement, the parties agree to provide upon request
of one party (requesting party) to the others (providing parties) such fire
protection and suppression personnel and to make available such equipment or
facilities as many be requested for -the suppression of fires within the
jurisdictional areas of the parties; provided that the personnel, equipment or
facilities requested are not otherwise required within the City or County
providing same as determined by the Fire Chief or Chief Fire Service Officer
of the providing party. Requests for mutual aid made pursuant to this Agreement
shall be made by and to the respective Fire Chiefs or Chief Service Officer
or their designated representatives.

MUTUAL AID FIRE PROTECTION AGREEMENT
WITH THE CITIES OF GEORGETOWN AND ROUND ROCK
THE STATE OF TEXAS
COUNTY OF WILLIAMSON
THIS AGREEMENT is made and entered into by, among and between
the City of GEORGETOWN AND ROUND ROCK in WILLIAMSON COUNTY, all
parties being municipal corporations duly organized and existing
under the laws of the State of Texas acting herein by and through
their respective Mayors duly authorized to so act by ordinance
or resolution duly passed by said Cities.
WITNESSETH:
WHEREAS, Article 4413(32c), TEXAS.REV.CIV.STAT.ANN., authorizes

Requests for mutual aid made pursuant to this Agreement shall
be made by and to the respective Fire Chiefs or Chief Service

II.
While any fire service officer regularly employed by or associated
with the providing party is in the service of a requesting party
pursuant to this Agreement, he shall be a fire service officer
of such requesting party and be under the command of the fire
service officer therein who is in charge in that municipality
(requesting party), with all the powers of a fire service officer
in such other municipality as fully as though he were within the
jurisdiction where he is regularly employed or associated and
his qualification, respectively, for office where regularly
employed in such other municipality, and no other oath, bond
or compensation need be made.
III.
Any civil liability related to the furnishing of services under
this Agreement is the responsibility of the governmental unit
which would be responsible for furnishing the services absent
the Agreement.
IV.
Each party to this Agreement shall be responsible for its own
costs and expenses.
V.
The term of this Agreement shall be indefinite with any party
having the right to terminate said Agreement upon thirty (30)
days notice to the other party.
VI.
The parties shall observe and comply with all Federal, State,
County and City laws, rules, ordinances and regulations in any
manner affecting the conduct of the services herein provided and
performance of all obligations undertaken by this Agreement.

RESOLUTION PURSUANT TO SENATE
BILL 411 ELECTING NOT TO PARTICIPATE
IN THE FIREMENS RELIEF AND RETIREMENT
FUND PROGRAM
WHEREAS, Senate Bill 411 of the Texas Legislature
created a Firefighters Relief and Retirement Fund
for firefighters who serve without monetary remuneration;
and
WHEREAS, the said Act provides for the administration
of the fund and the distribution of benefits, establishing
solvency and disclosure requirements for all firefighters
pension plans for firefighters who serve without monetary
remuneration; and
WHEREAS, said Act provides that contributions and benefits
shall not be considered compensation for such services; and
WHEREAS, the membership of the Volunteer Firefighting
Department of Georgetown, Williamson County, Texas has
elected to waive any rights under said Volunteer Firemen's
Relief and Retirement Fund and has elected not to be covered
by said Act; and
WHEREAS, said Senate Bill 411 requires a city which
elects not to participate in the fund must adopt a resolution
exempting itself from the requirements of the Act no later
than October 28, 1977:
THEREFORE, BE IT RESOLVED, by the City Council of
the City of Georgetown at its regular meeting on October 11,
1977, does hereby enact the resolution as follows:
RESOLVED, the City of Georgetown, Texas does hereby
elect not to participate in the Volunteer Firemens
Relief and Retirement Fund.
The foregoing resolution was on this date passed by a
unanimous vote by all voting members of the City Council.

Dear Sirs
In view of the recent Attorney General's ruling concerning paid firemen partici.,
gating as volunteers on off-duty hours, the Board of Commissioners of the George-
town Fire Department Pension Fund has passed the following Resolutions
"WHEREAS, Wilburn Louis Barker has been a member of the Georgetown Volunteer
Fire Department since February 7, 1966 and joined the Pension Fund on April 9, 1966;
and was employed as a City Paid Fireman on October 13, 1966 and was informed that
he could not continue to belong to the Pension Fund; and
WHEREAS, the records of the Georgetown Fire Departmoet show that Wilburn
Louis Barker has since January 1, 1967 to December 31, 1975, been active in his
attendance at more than the required amount of fires and drills; and
WHERE43,0 the previous Firemen's Pension Commissioners had stated that he
could not participate; and
WHEREAS, Wilburn Louis Barker is willing said able to contribute the required
amount of money for the years 1967 through 1975; now therefore be it
RKSOLVED that Wilburn Louis Barker be granted credit for good servioe for re-
tirement purposes for the years of 1967 through 1973.
