HomeMy WebLinkAbout0022_1940STATE OF TEXAS, * KNOW ALL NEN BY THESE PRESENTS: COUNTY OF WILT AMSON . * That we, Minnie l : Woodard and Willie Ethel Woodard,, single women, of Williamson County, Texas, as Independent Ex- ecutrices of the Wills -and Estates of I. N. Woodard and W. E. °,,Ifoodard, Deceased, for and in consideration of. the sum of Fifty($50.00)Dollars cash to us in hand paid by the City of Georgetown, Texas, the receipt of which is hereby acknowledged, do hereby Give and Grant to the said City- of Georgetown, a municipal corporation situated in Williamson County, Texas, the Easement and Right to construct, re -construct, and per.. petually maintain a sanitary sewer line and main in, upon and across a tract of about twenty-five(25) acres of land out of the Nicholas Porter Survey, in Williamson County, Texas, being the First Tract described in a Deed from August Anderson and wife, Mollie Anderson, to the grantors herein, which Deed is dated November 4th, 1935, and appears of record in volume 2769 Page 378, of the Deed Records of Williamson County, Texas, to which Deed and the record thereof reference is here madeq this Easement covering a strip of land 2D feet wide across the above mentioned 25 acre tract, the center line of said strip beginning at a point in the West line of the above mentioned 25 acre tract of land, which point is 326 feet in a Northerly direction from the Southwest corner of said 25 acre tract of land; Thence said Center Line to run in an Easterly direction for a distance of, SOS feet, to a point in the East fence line of said 25 acre tract of land, which last mentioned point is 353 feet in a Northerly direction from a Southeast corner of said 25 acre tract, and which last mentioned point is also 376 feet in a Northerly direction from the Southwest corner of the present City of Georgetown Sewer Field Tract* It is understood and agreed that the #ewer line or main land by the City of Georgetown along the center line of the above mentioned strip of land shall be laid at all points across said land at a minimum depth of two feet. TO HAVE AN'D TO HOLD said Easement and Right perpetually to the said City of Georgetown, and its successors, together with the right and privilege at any and all times to enter said premises for the purpose of constructing, reconstruct- ing, repairing and maintaining said sewer. It is further understood and agreed that the said City of Georgetown will at all times after doing any work in con- nection with the construction, re -construction, repair or maintenance of said sewer line, restore said premises to the condition in which same were found before such work was under- taken, and that in the use of said rights and privileges here- in granted, the said City of Georgetown will not create a nui- sance, and will not leave the entrances to said property open, and will exercise its said rights and privileges in a way to interfere as little as possible with the grantors' use of said property for other purposes. It is further understood and agreed that at this time the said City of Georgetown has and is maintaining a sewer line across said 25 acre tract of land at a point farther North than the point covered by this Easement , and that as soon as the said City of Georgetown has completed its proposed sewer line across said 25 acre tract of land at the point hereinabove described, and has connected said new sewer line with its sewer system, then the said City of Georgetown shall abandon said old sewer line, and shall have no further rights under said previous easement, and the said City of Georgetown shall not disturb the surface of the ground by excavating and digging up said old sewer line, and shall leave same in the ground.
