for each additional quarter or fraction thereof (route measurements) for
the private line or circuit which should be used solely in the operation
of the proposed fire alarm system.
2. It is understood by the parties hereto that the Telephone
Company cannot and does not guarantee uninterrupted service of the circuit,
nor does it ,guarantee that the circuit and the equipment so situate in its
central office will be in working, condition when its use is attempted;
therefore, in view of the possibility of errors, delays, interruptions,
and difficulties in the use of such equipment and Q1,rcuiii and the impos-
sibility of guarding against them, the City assumes all risks connected
with the repair, maintenance and use of such equipment and circuit and
asstrnes all risks of any failure of the equipment and circuit with an:Y
attempt to use the same. No liability whatsoever shall attach to the
Telephone Company for any interruptions, faulty conditions, faulty repair
or maintenance by anyone or for any failure of circuit or device to ope-
rate successfully.
3. The furnishing of this equipment and circuit is at the
special instance and request of the City nor the sole use and convenience
of the City of Georgetown in the operation of its fire alarm equipment
and s1,rste. and the service is limited to that purpose, and this contract
and agreement is not intended for the benefit, nor shall it inure to the
benefit, of any other parsons, firm or corporation.
4. ;_ny person repairing or maintaining or making use of the
equipment, the circuit and/or device is hereby made the agent of the City
and should any work or repair be done or performed on the equipment or
circuit by employees of The Telephone Company, such person shall be the
agents and employees of the City during the period the work or repair is
in progress. It is agreed, however, that the employees of the Telephone
Company, while doing work for or making repairs for the City, shall, never-
theless, be deemed employees of the Telephone Company under the 'orkmen's
Compensation Law of the State of Texas for all liability as to personal
injuries and death suffered by said Telephone Company employees, but not
otherwise.
5. The City hereby expressly contracts to fully and completely
hold and save harmless the Telephone �'Jompany, its successors and assigns,
