be re constructed, Since the existincr street constitutes a danger and serious in-
convenience to the public, it is ur,-ently required to be remedied: and
"!F';8!'S, the city has requested the State of Texas to contribute financial-
ly in the street project; and
E'S, the State of Texas has made it knorm to the city that it will
assist the city in the street project by furnishing the necessary funds for actual
construction, reconstruction and maintenance; and by supervising construction, pro-
vidinrM the city approves the plens, tirades and alirnment for said project; and
EAS, the ci.t'r, in consideration of the providin- of seid project,
agrees to inder.nify the State of Texas aCs.inst a.11. damaMes oryclaims for damage to
adjoining,.abuttin- or other property for which the State is liable, arisin!^ out
of, incident to, and in any way connected with the installation, the re constrile-
tion,the existence, the use !!�nd mainrer+A.nce of the street Project or the passa e
and enforcement of this ordinance.
NOfi TEEREFORE, <E IT OPT)ATIdFD BY T};r CITY COUNCIL:
SECTION 1. That since the n1,bl4.c cor_cenl rl,nce, safety and necessity of the
cit -r and th.epeople of the cit, require it, said street shall be re constructed.
SEC`1'ION 2. That the State of TPxgs be and is herebir aut'-ori.zed to enter
�?^on reconstruct and maintain the street project at the location and in the r.,a.nner
shown on the nlan.s, attached hereto and marked "Exhibit A" and made a part hereof
in all respects.
S'.C�ION 3. That nothing i.n this ordinance shall be construed to obli.r-ate
the State of Texas to pay any direct, incidental, or consequential damages to
adjoining, abutting, or other property in enforcement of this ordinance or by
reason of the installation, reconstruction, existence, use and maintenance of
the street proAect authorized herein.
