HomeMy WebLinkAbout0145_143143 That Eastward , Zone No. 3, begins at the east end of Zone Number 2, and extends eastward along the said Street to the fast City Limits, and that the maximum rate of speed on this zone is 35 miles per hour. That Twelfth Street is hereby zoned for Yeatbound traffic thereon, and speed rate for zones fixed as follows: That Vyestbound, 'Lone Number 1, be- gind at the East City Limits and extends westward along the said Street to a point that•is two tenths(2/10) of a mile west from the East City Limits and that the rate of speed on this Zone Number 1, shall not exceed 35 miles per hours That Westward, Zone Number 2, shall begin at the ',:est end of said Zone Number 1, and shall extend westward along the said Street to a point that is two tenth (2/10) of a mile east from the i4est City Limits, and that maximum rate of speed on this 'Lone Number 2, shall be 30 miles per hour. That Westward, Zone Number 3, shall begin at the west end of said Zone Number 2, and shall con- tinue westward along said Street to the tiniest City Limits, and the rate of speed on this zone shall not exceed 35 miles per hour. That the maximum rate of speed for motor vehicles upon each of the remaining Streets of said City, and all parts of such remaining Streets is here fixed at -30 miles per hour. SECTION II That all of the Streets of this City, and all portions of any such streets, are hereby declared to be public streets, and that the driving or operating of any motor vehicle on or along any portion of any street of this City at a rate of speed that is greater than the maximum rate of speed for said portion of said street, as fixed by this ordinance shall be guilty of a misdemeanor, which is named, "The Offence of Speeding", and that the said offence is punishable by fine of not less than one 01.00) dol- lar nor more than two hundred ( $200.00) dollars. That the use of the word, "Speeding" shall be sufficient to designaa the said offence, and shall mean that a motor vehicle has been driven upona public street, at a greater rate of speed, than that fixed by this ordinance, for the street, and for the zone thereof, that such motor vehicle wads so being driven upon, if zoned. That in prosecutions under this ordinance, for the offence of speeding, the complaint, if in other respects sufficient in form, shall as to the portion thereof seeking to allege the offence, be sufficient if it in substance alleges that the defendent did while driving a motor vehicle in said City commit the offence of "Speeding". SECTION III That should any Section, or any portion of any Section hereof be decreed to be void, the invalidity of such Section or such portion thereof shall not affect the validity of the remaining portions of this ordinance s and that each Section, and each portion thereof, not decreed to be invalid, shall remain valid and enforceable. That only all ordinances and parts of ordinances that are in conflict with this ordinance are hereby repealed, and that it is cumulative of all others. That the fact that prompt action should be taken in the regula- tion of traffic, on the streets of this City, in the manner provided for in this ordinance, creates an emergency requiring that the rules that provide that an ordinance shall be read at three separate meetings of the City Council before final passages be suspended, and that the said rules are hereby suspended, and this ordinance is here and now passed, and that it is ordered that it take effect from and after its passage and publication.
