HomeMy WebLinkAbout0040_3939 AGREEMENT FOR CONSTRUCTION, MAINTENANCE AND OPERATION OF SAFETY LIGHTING SYSTEM WITHIN MUNICIPALITY THE STATE OF TEXAS COUNTY OF WILLIAMSON This AGREEMENT, made this 12th day of December, 1966, by and between the State of Texas, hereinafter called the "State", Party of the First Part; and the City of Georgetown, Williamson County, Texas, acting by and through its duly authorized officers under aaResolution passed the 12th day of December, 1966, hereinafter called the "City", Party of the Second Part: WITN,ZSSETH WHEREAS, the City has authorized the installation of highway safety lighting system by Resolution passed on the 12th -day of December, 1966, at the locations shown on EXHIBIT 1, attached hereto and made a part hereof, in the City: d� AGREEMENT V V NOW, thered6re, in consideration of the premises and of the mutual cove - pants and agreements of the parties hereto to be by them respectively kept and performed, as hereinafter set forth, it is agreed•as follows; 1. The State will furnish the necessary funds for the actual construction, prepare plans and specifications, install said highway safety lighting system, supervise construction, and upon completion of construction, will furnish the power and operate and maintain said highway safety lighting system. 2. The City hereby consents to the construction of the highway safety light- ing system shown on EXHIBIT 1 by the approval of the location and manner of construction as shown on plans and described in specifications attached hereto, marked EXHIBIT 2, and made a part hereof. 3. The City will exercise no control whatsoever over the operation, main- tenance, use, or existence of the highway safety lighting system without written authority from the State Highway Engineer. 4. The State shall have the authority to make such changes in the design and operation of the highway safety lighting system as it may deem necessary and advisable to promote the safe, convenient, and orderly move - meat of traffic. 5. The City will be responsible for the police enforcements 6. The City agrees to deliver, or cause to be delivered, the necessary electrical energy to the power station or stations, which will be constructed free of cost to the State, at points designated by the State, including the construction of any necessary power lines and incidental equipment, such as photo -electric switches, necessary to connect the safety lighting system to the power stations.
