(d) That the lease shall provide for a primary term of not more than
(10) years from the date of said lease.
SECTION III.
That the City of Georgetown is hereby authorized and directed to cause
to be published once a week for three consecutive weeks, in a newspaper having
general circulation in Williamson County, Texas, the following form of notice
for said lease above mentioned, evidencing the City's intention to sell same:
"STATE OF TEXAS:
COUNTY OF WILLIAMSON
"Notice is hereby given that the City of Georgetown, Texas,
acting through its duly authorized governing body, the City Council,
will, on the 0th day of October, 1967, at the City Hall in the City of
Georgetown, County of Williamson, State of Texas, at 8:00 o'clock P.M., sell
at public auction to the highest bidder an oil, gas, and mineral lease on the
following described tract of land belonging to said City:
"The terms on which said City of Georgetown will sell said lease are
as follows:

"(1) The City Council reserves the privilege of rejecting all bids
not deemed by it to be representative of the fair value of
such lease.
"(2) Such lease is to contain a provision authorizing the lessee
to pool or unitize the rights covered by said lease as to
oil or gas on, in or under the above-described land with any
other lands, leases, mineral estates, or parts thereof, to
form a drilling or spacing unit or units for the exploration,
development, and production of oil or gas; provided, the
drilling or spacing units shall not exceed the minimum number
of acres upon which an oil or gas well may be located in order
to comply with the rules, regulations, or orders of the Rail-
road Commission of Texas or any other regulatory body, state
or federal,,having authority to control or regulate the
spacing of such oil or gas wells.
"(3) Such lease also to contain a provision prohibiting the lessee
from conducting under the terms of said lease any operations
upon the surface of said land covered by said lease, and pro-
viding that lessee shall have the right of exploring, drilling,
mining and operating for and producing any or all the minerals
covered by said lease in and under said land by operations
located on lands pooled or unitized therewith and/or through
any operations which do not involve the use of the surface
of said land.
"(4) The royalty reserved to the City of Georgetown shall not be
less than one-eighth; provided, however, that on production
from a pooled unit only such proportion of the royalty
provided for in such lease shall be due as the amount of lessor's
acreage in the unit or its royalty interest therein on an
acreage basis bears to the total, acreage contained in the unit.
"(5) The primary term of such lease shall not exceed ten (10) years.
