RESOLUTION AUTHORIZING MAYOR OF THE CITY OF GEORGETOWN
TO EXECUTE AGREEMENT AND RELEASE.
WHEREAS, heretofore by instrument dated February 10, 1941, and recorded in Volume
305, Page 599, of the Deed Records of Williamson County, Texas, the Belford Lumber Company
conveyed to J. M. Shell, Jr. certain real property located in Georgetown, Williamson County,
Texas, and said document contains the recital as follows:
"An easement conveyed by the grantor herein to the City of Georgetown, giving and granting
to said City certain Easements and Rights in connection with the construction and maintenance
of the Dam and Lake on the South San Gabriel River, which adjoins the land herein conveyed,
and which is known as "The Imhoff Dam", and also an Easement to said City of a Power Line."
PASSED on first reading this 9th day of September, 1974.

and,
WHEREAS, said recital constitutes a cloud on the title to said real property and further
because the City of Georgetown has no need for an easement on said land relative to the
Imhoff Dam; and,
WHEREAS, there are certain utilities, water lines and electrical distribution lines and
appurtenances, in place on said described land but there are no rights-of-way nor easements

regarding same in the records of Williamson County, Texas; and,
WHEREAS, it is deemed desirable and to the best interest of the parties concerned for
the City of Georgetown, Texas, a Municipal Corporation located in Williamson County, Texas,
and Ronald E. Tynes, Trustee, of Austin, Travis County, Texas, the present owner of said
land described in said deed along with other adjacent land not described therein, to enter
into certain written agreements whereby the City will eliminate the aforesaid claim of title
by a full release of any claim of any easements over, under or across aid land EXCEPT definitive
utility easements to cover those easements as aforesaid that are presently in place on the ground
and for and in consideration of the receipt of such release said Ronald E. Tynes, Trustee,
is willing to grant the express easements as aforesaid:
THEREFORE, BE IT RESOLVED, that the Mayor of the city of Georgetown, Texas, is
hereby authorized to execute a full and complete relaese and discharge of the easements,
if any, relative to the Imhoff Dam as aforesaid upon receipt of delivery from Ronald E. Tynes,
Trustee, of the water and electrical power and distribution lines as aforesaid covering and making
provision for the said utility lines that are actually in place on said land.
