HomeMy WebLinkAbout0236_234RESOLUTION AUTHORIZING ADVISORY COMMITTEE TO ACT ON BEHALF OF WHOLESALE CUSOTMERS IN OPPOSITION TO APPLICATION NO. 3866 OF THE COLORADO RIVER MUNICIPAL WATER DISTRICT. WHEREAS, the City of Georgetown is a purchaser of electric power wholesale from the Lower Colorado River Authority ("LCRA") and is a member of a group of ten electric cooperatives and twenty-nine cities each of which purchases electric power wholesale from LCRA (collectively, the "Wholesale Customers"); and WHEREAS, the Colorado River Municipal Water District ("CRMWD") has filed with the Texas Department of Water Resources Application No. 3866 for a permit under Section 11.121 of the Texas Water Code to construct a dam and reservoir on the Colorado River near Stacy, Texas, ("Stacy Reservoir"), to impound water in the reservoir, and to divert and use water from the reservoir for municipal and industrial purposes; and WHEREAS, it appears that the impounding and use of water from Stacy Reservoir will affect adversely the interests of the Wholesale Customers by increasing significantly the cost to LCRA of generating electric power, which cost must be borne by the Wholesale Customers as purchasers of such power; and WHEREAS, the City of Georgetown desires to oppose Application No. 3866 of the CRMWD insofar as the granting of the application will adversely affect the cost of electricity produced by LCRA; and WHEREAS, an "Advisory Committee" of the Wholesale Customers (the members of which are listed in Appendix "A" attached hereto) has been formed and is composed of four cities and three electric cooperatives with interests representative of the entire group of Wholesale Customers; and WHEREAS, because of the large number of members that comprise the Wholesale Customers, it is in the best interests of each member to authorize the Advisory Committee to act on behalf of the members of the Wholesale Customers. NOW, THEREFORE, BE IT RESOLVED BY THE City Council of the City of Georgetown, THAT the Advisory Committee, as it, is presently composed or as it may be composed in the future, is hereby authorized and directed to take any and all action it deems reasonable and necessary on behalf of the City of Georgetown, both individually and as a member of the Wholesale Customers, in opposition to Application No. 3866 of the CRMWD, including the hiring of legal counsel to prepare for, and appear in representation of the Wholesale Customers at, the hearing on Application No. 3866 before the Texas Water Commission; and BE IT FURTHER RESOLVED that the Advisory Committee apprise the Texas Water Commission of the serious ramifications that the granting of said permit will have on the cost of generating electricity by LCRA, which cost will be borne by the Wholesale Customers in the purchase of electric power from LCRA.
