and other minerals reserved in deed from T. E. Nelson to Oscar Collier, dated
June 27, 1941, recorded in Volume 307, page 492, of the Deed Records of William-
son County, Texas.
2. A 1/32 non -participating royalty in and to oil, gas and other
minerals reserved in deed from J. D Thornton, et al. to A. H. Robinson, Jr.,
et al., dated September 12, 1956, recorded in Volume 413, page 393, of the
Deed Records of Williamson County, Texas
3. A 1/16th non -participating royalty in and to oil, gas and other
minerals reserved in deed from T. E. Nelson to C P. Faubion, et al., dated
May 21, 1941, recorded in Volume 307, page 475, of the Deed Records of William-
son County, Texas
4. R.O.W. deed dated August 2, 1955, recorded in Volume 408, page 393,
of the Deed Records of Williamson County, Texas.
5. Easement dated August, 1963, from W. L. Barnes and wife, Lillian
Barnes, to Brushy Creek Water District Improvement and Control 01, recorded in
Volume 463, page 296, of the Deed Records of Williamson County, Texas.
6. This conveyance is made subject to, and the Grantee herein does
not assume payment of the unpaid balance due and owing on that certain all-in-
clusive wraparound promissory note in the original principal sum of $1,422,335.17,
dated May 1, 1974, executed by Henry S. Miller Company, Trustee, and payable to
the order of W L. Barnes and Lillian E. Barnes secured by a vendor's lien re-
tained in the deed dated May 1, 1974, filed for record and additionally secured
by a deed of trust of even date therewith to John Calhoun Miller, Trustee, filed
for record in Volume 171, page 87 , of the Deed of Trust Records of Williamson
County, Texas, but takes subject to the same
It is further agreed and understood, however, that this conveyance
is made subject to the following indebtedness
That certain deed of trust executed by W L. Barnes and wife, Lillian
E. Barnes, to James L. Cutcher, Trustee, dated November 23, 1970, recorded in
Book 144, page 98, of the Deed of Trust Records of Williamson County, Texas,
and given as additional security for the payment of the certain purchase money
note of even date therewith, for the principal sum of $95,675.58, payable to
