requirements, additional manholes, or other additiona
requirements of the City will be paid by the City.
2. Contemporaneously with the execution of this Agreement by all
parties, McKeithan will request the Court of dissolve all
temporary restraining orders or injunctions then in effect.
3. McKeithan agrees to completely dismiss the above -entitled
and numbered lawsuit against the City, Tom Sams and Southwestern upon
the occurence of either of the following events, whichever occrs
soonest:
(a) When McKeithan enters into an oversizing
agreement with the City, obtains approval of
his engineering plans, and obtains the
necessary permits or easements from the Texas
Highway Department, or
(b) Forty-five (45) days from the date
hereof, unless prior to that time he shall
have determined that any of the parties hereto
is not acting in good faith in performance of
its covenants contained herein and shall have
given written notice to the parties setting
forth his reason (s) to believe that one or
more of the parties has not acted in good faith.
Ther terms hereof are not binding until all parties have affixed their
signatures hereto.
