HomeMy WebLinkAbout0324_363363 THE STATE OF TEXAS § § KNOW ALL MEN BY THESE PRESENTS: COUNTY OF WILLIAMSON § RELEASE OF AGREEMENT WHEREAS, by instrument dated February 16, 1982, the Industrial Corporation of Georgetown, a Texas Corporation, herein sometimes called Corporation, and the City of Georgetown, Texas, a Texas municipal corporation, herein sometimes called City, entered into a certain agreement for the purpose of constructing twelve inch (12") sewer and water lines along the east right of additional cost to construct twelve inch (1211) sewer and water lines, and WHEREAS, it was agreed therein that Corporation would not develop or dispose of its property for residential purposes as long as Corporation owned said property, and WHEREAS, the Corporation has paid City the stun of $51,851 .5 0 cash in hand paid the receipt of which is hereby acknowledged for the construction of said sewer and water lines, and it is not intent of the City to further restrict the use cf said property so as to prohibit the residential use thereof, THEREFORE, KNOW ALL MEN BY THESE PRESENTS: That, for and in consideration of the payment to City for the sewer and water lines as contracted by the agreement dated January 16, 1982, in the amount of $51,851.50 cash in hand paid, City does hereby waive such restrictive covenant and hereby releases and discharges the Corporation from the said agreement and particularly that portion regarding development and disposition of Corporation's property for residential purposes and said agreement shall no longer be binding upon the Corporation or City, and said land may be used for any lawful purpose.
