HomeMy WebLinkAbout0168_167ORDINANCE N0, 84 - #).'3 , 0'71 AN ORDINANCE OF THE CITY OF GEORGETOWN ESTABLISHING CAPITAL RECOJERY FEES FOR WATER AND WASTEWATER UfILI'fIES; PROVIDING METHOD OF DErERMININ3 SUCH FEES; FIXING MAXIMUM AND MINIMUM SIZES APPLICABLE fO SINGLE FAMILY RESIDENCES; PROVIDING TIME OF PAinNr; DISTINGUISHING^ SAID FEE FROM UrILIrY TAPS; PROVIDING CITY LIABILITY LIMITS; PROVIDING FOR APPLICATION OF FEES IN REMODELING WITH EXCEPTIONS; PROVIDING FOR COmPUrATION OF SUCH FEES FOR COMMERCIAL STRUCTURES UTILIZING METER SIZE AND LIVING UNir EQUIVALENrS; REQUIRING CITY ENGINEERS REVIEA ON INDUSTRIAL AAD FACTORY APPLICArI0v5; SErfING TIME LI%1IfS AND PROCEDURES REGARDING SUCH APPLICATIONS; PROVIDING FOR APPEAL; REQUIRING SEPARATE ACCOiJd rS FOR FEES; PROVIDING FOR COUNCIL REVIEW: CONrAININGS SEVERABILITY CLAUSE AND DECLARING AN EMERGENCY. WHEREAS, the need exists for a comprehensive financial plan for the water and wastewater utilities so that new projects can be financed; and, WHEREAS, the citizens of Georgetown will best be served if new developments and projects pay for a portion of the cost associated with providing water and wastewater services to such developments and projects; Now, Therefore, BE Ir ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN: Section 1. That a base capital recovery fee of $1,000.00 for water and $500.00 for wastewater per living unit equivalent is hzreby established for all property served by the City of Georgetown with such utility services. Section 2. The base fees established in Section 1. of this Ordinance shall be increased or decreased for single family residences, duplexes, fourplexe3, apartments and other residential structures depending on the square footage contained in such structures. Sucn square footage will be multiplied by $0.50 for water services involved ani $0.25 where wa3tewater service is involved and the amount of the base fee will be increased or decreased to equal the product of the said square footage computation. Square footage shall be determined exclusive of garages, porches, carports and patios. Square footage relative to single .family residences shall have a 3000 sgaare feet maximu.n and a 1200 square feet minimum f -)r parpc3.�3 of of f?.'i. Slu-ar: U)ot:ije in a ain3le fa.nily -re3idenct in exca:;s of 3000 s lu-ire fast shall not be consi3ered in the fee det-:�rminstion and a minimum of 1200 square feet shall be used in such computation even if the structure in question contains less than 1200 square feet. Such square footage maximum and minimum shall not be applicable to multifamily nor commercial structures. Such fees shall be paid at the time of issuance of the applicable utility permits. No utility connections shall be made until such fees are fully paid. Th:ii capital recovery fees provided for herein are in addition to utility tap fees. The payment and collection of the fee established and levied by this section shall in no way obligate the City of Georgetown to provide any specific utility service and shall in no way guarantee any specific level or quality of service. Said capital recovery fees shall also be paid in connection with additions or remodeling of structures which require the issuance of a plumbing permit. However, no such fees shall be charged in connection with additions or remodeling where same are done to the existing residential units unless such addition contains an additional separate kitchen. facklity requiring a plumbing permit in which event said fees shall be paid in accordance herewith. Section 3. The utility base fee for commercial structures shall be determined by mutiplying the sai,i base amount times the living unit equivalents that is determined by the water meter size shown on the schedule as follows: WATER MErER SIZE LIVING UNIT EQUIVALENT (Inches) 5/8 1 3/4 1.5 1 2.5 1-1/2 5 2 8 /b f 3 WATER METER SIZE (Inches) 15 LIVING UNIT EQUIVALENT 4 25 6 80 a 140 10 220 12 270 Factory and Industrial applications for such utility permits shall contain such information as.may be'required by the City and the fees shall be fixed after review by the City Engineers. The remodeling of commercial structures shall require the payment of additional Capital Recovery Fees if the meter size or number of maters is increased. A remodeling resulting in a decreased meter size shall not entitle the permitse to any refunds. Section 4. The right to connect a structure to the City of Georgetown utility system shall remain valid for a period of eighteen (18) months. Such right may not be transferred nor assigned to any other site. Such time may be ext.ended for an additional term not to exceed one year upon written application filed not leas than sixty (60) days prior to the terinination date. In the event of permit termination, the sums paid shall not be refundable. The owner of the tract involved may reapply for such permits at a later date and in such event all sums previously paid shall be credited toward such reapplication. Section 5. Tne. City Council of the City of Georgetown or a board designated by the City Council shall serve as an appeal board in the event one affected by this Ordinance wishes to file an appeal from its application. All expenses incurred in connection with such appeal shall be paid by the appealant. Section 6. The fees provided for herein shall not apply unless the structure involved is to be provided with the City utility in question. Section 7. All fees gant-r;tai by this Ordinance shall be deposited into sepirite account; as follows: Water Distribution Lines Fund Water Treatment Plant Fund The sums received for water service shall be divided equally between the two above accounts. Wastewater Collection Line Fund Wastewater Treatment Plant Fund The sums received for waste water service shall be divided equally between the two above accounts. Section 8.. This Ordinance and its administration shall be reviewe3 by the City Council of the City of Georgetown no less frequently than annually. Section 9. If any provision, section, sentence, clause or phrase of this Ordinance, or the application of same to any person or set of circumstances is for any reason held to be unconstitutional, void, or invalid (or for any reason unenforceable), the validity of the remaining portions of this Ordinance or this application to other persons or sats of circumstances shall not be affected thereby, it being the intent of the City Council of the City of Georgetown in adopting this Ordinance that no portion hereof nor provision or regulation contained herein become inoperative or fail by reasonof any unconstitutionality or invalidity of any other portion, provision or regulation. Section 10. The rule re:guiring the reading of ordinances on two (2) separate days is h-areby suspended and this Ordinance shall become effective on this the day of its passage for the reason that it is to the bast interest of said City for such fees to be collected without delay and for the reason that Emergency Passage will enable those who wish to connect to available City utility sevices to proceed with construction projects without delay. The foregoing Ordinance was passed as an emergency measure on first reaiing on motion duly tn3da and pa33ed by the unanimous affirmative vote of all City Council members on this the 10th day of January, 1984. .
