days after the giving of such notice. Said appraisers shall
meet as soon as possible after their selection and shall appraise
said entire system of sewerage at its reasonable value and shall
and shall make their award in writing in duplicate within Thirty
(30) days after said 13th, day of August, 1909, or the expiration
of said Bive (5) years, and one copy of such award shall within
such time be delivered to the Mayor of the City of Georgetown,
and one copy to said John R. Allen and L. Marshalls their assoc-
iates, successors and assigns. The said City of Georgetown shall
within six months after said appraisers have made their award
pay the amount so awarded in cash# or by said City assuming in-
debtedness of the said John R. Allen and L. Marshall, their
associates, successors and assigns, due on said system of sewer-
age, not to exceed the value as shown by said appraisementp and
paying balance, if any, in cash as aforesaid. And a failure to
pay the amount of the a ppraisement in the time and manner here-
inbefore specified, or a failure to give notice of intention to
buy as above provided, shall operate as a waiver of a right to
purchase until the expiration of another five years. And another
provision in the granting of this franchise is that the said
John R. Allen and L. Marshall, their associates, successors and
assigns, shall faithfully observe and perform all the terms and
conditions and requirements of this ordinance in whole and in
part. The expense of such appraisement shall be borne equally
by the City and the said John R. Allen and L. Marshalls their
associates, successors and assigns.
Section 2. 'The said John R. Allen and L. Marshall, their
associates, successors and assigns, shall exercise due care and
diligence in the use of the streets, alleys and public places
of this City, and shall cause no unnecessary obstruction to pub-
lio travel over or upon the same, and shall not injure or inter-
fere with other pipes, either gas, water or sewerp vhich may be
lawfully located beneath the surface thereof. And said John R.
Allen and L. Marshall, their associates, successors and assigns,
shall take every reasonable precaution against accidents or damage
to persons or property in the exercise of the rights and privileges
herein granted, and shall cause all excavations to be properly
lighted or guarded at night, and after the completion of the pur-
pose for which the said streets, alleys and public places shall
be restored to their former condition without unnecessary delay.
