HomeMy WebLinkAbout0242_00026. No trailer, mobile home, or other buildings of tem- porary nature shall be placed on any properties located in said subdivision. All other property, i,.e. Lots One through'Four in Block "A" of said subdivision may used for multi -family dwellings, service stations or other, non -industrial, commercial and/or retail purposes, and Lots: one through Ten in Block "S", of said subdivision may be used for multi -family dwellings. In the event the.undersigned, or any of its assigns, or any other person owing lots within this subdivision, shall fail or refuse to comply with or shall violate or attempt to violate any of the covenants and provisions herein contained, or shall cause or suffer the same to beviolated, the under- signed partnership, its legal representatives, successors or assigns, or any other person owning property in this 'subdivision, shall have a right of action to prosecute any proceedings in law or in equity against the person or persons so failing or refusing to. comply, or violating or attempting to violate any of the covenants or provisions herein contained, for the pur- pose of recovering damages for such acts, and the prevention of the continuance of .such acts; and in addition, in the event of the breach of any of the covenants and provisions herein contained, the title to the lot or lots upon which such breach occurs, together with all appurtenances thereto shall, upon the failure or refusal of the owner of such lot or lots to fully comply with the provisions herein within six months after receiving notice in writing of the existence of such breach :or violation of the provisions hereof, then and there wholly and .absolutely revert to the undersigned partnership, its assigns and.successors; provided, however, that this provision for reversion shall effect any valid subsisting lien then upon said lot or lots: except that title to said lot or lots. shall revertto the undersigned partnership, its successors and assigns, subject to such lien, and providing further that notwithstanding anything to the contrary herein contained, no holder of any lien now in effect or hereinafter -3- S
