AN ORDINANCE VACATING AND ABANDONING THAT CERTAIN
ALLEYWAY RUNNING ALONG THE ENTIRE SOUTH SIDE OF LOT 9,
MONTGOMERY ADDITION, CITY OF GEORGETOWN, WILLIAMSON
COUNTY, TEXAS, MORE PARTICULARLY DESCRIBED IN EXHIBITS
"A & B", ATTACHED HERETO AND MADE A PART HEREOF;
RESERVING AND EXCEPTING UNTO THE CITY OF GEORGETOWN,
ITS SUCCESSORS AND ASSIGNS, THAT CERTAIN EIGHT FOOT
WIDE STRIP AS A DRAINAGE AND UTILITY EASEMENT ALONG THE
ENTIRE SOUTH SIDE OF SAID ALLEYWAY, AND RESERVING AND
EXCEPTING ANY PART OF THE ABANDONED PORTION OF THE
ALLEYWAY IF THERE ARE ANY FUNCTIONING UTILITY LINES OR
APPURTENANCES THERETO LOCATED ON SAID ABANDONED
PORTION, WITH THE RIGHT TO MAINTAIN, REPAIR, REPLACE,
OR REMOVE, AS MAY BE NECESSARY FROM TIME TO TIME, ANY
EXISTING WATER, SEWER, DRAINAGE, ELECTRIC OR OTHER
UTILILTY LINES AND APPURTENANCES ON, UNDER, ACROSS OR
OVER SAID ABANDONED PORTION.
WHEREAS, a petition has been received from James Chambers
and wife, Gayla Chambers and Richard E. Heckman and wife, Frances
Heckman, being all of the abutting owners of land to that
alleyway more particularly described on Exhibits "A & B"; and
WHEREAS, the City of Georgetown has not utilised said
alleyway for twenty-five years or more and petitioners own
certain improvements situated on said alleyway and the City of
Georgetown has no need for said alleyway except for an eight foot
wide drainage and utility easement along the entire South side of
said alleyway.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF GEORGETOWN, TEXAS, that that certain alleyway described
in Exhibits "A & B" is hereby vacated, closed and abandoned Save
and Except that the City of Georgetown reserves unto itself, its
successors and assigns a certain eight foot wide strip of land as
a utility and drainage easement along the entire south side of
said alleyway described in Exhibit "A & B" and reserves and
excepts unto itself, its successors and assigns any part of the
abandoned portion of the alleyway if there are any functioning
utility lines or appurtenances thereto located on said abandoned
portion with the right to maintain, repair, replace, or remove,
as may be necessary from time to time, any existing water,
drainage, sewer, electric or other utility lines and
appurtenances on, under, across or over said abandoned portion.
