HomeMy WebLinkAboutORD 03.12.1973 - Hospital AuthorityCERTIFICATE FOR AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, CREATING A HOSPITAL AUTHORITY UNDER AND BY VIRTUE OF THE POWERS CONFERRED UPON SAID CITY BY THE HOSPITAL AUTHORITIES ACT; DESIG- NATING THE NAME BY WHICH SAID DISTRICT SHALL BE KNOWN; APPOINTING THE BOARD OF DIRECTORS; DEFINING THE BOUNDARIES THEREOF; ENACTING PROVISIONS INCIDENT AND RELATED TO THE SUBJECT AND PURPOSE OF THIS ORDINANCE; AND DECLARING AN EMERGENCY. THE STATE OF TEXAS : COUNTY OF WILLIAMSON CITY OF GEORGETOWN We, the undersigned, Mayor and City Secretary, respective. ly, of said City, hereby certify as follows: 1. That the attached -,and following is a true, full and correct copy of an Ordinance Creating a Hospital Authority which Ordinance has been duly recorded in the minutes of the City Council of said City. 2. That said Ordinance was passed on first reading by the City Council of said City at a Special Meeting held at the regular meeting place on the 1st. day of March, 1973, and finally passed by said City Council on second reading at a Regular Meeting on the 12th day of March, 1973. 3. That on the dates of both of said meetings, the following were, and are now, the members and officers of said City Council: Joe E. Crawford, Mayor Dee Scott, J. D. Wininger, Hubert Brock, Claud Eads Harry Gold, William R. Eanes, , City Secretary, 4. That at the first of the aforesaid meetings, all of the members and officers of said City Council were present, except the following absentees: _ _ g oA2 E_ and said Ordinance was introduced for the consideration of sa City Council by its presiding officer, and read in full, and, upon motion duly made and seconded, said Ordinance was passed on first reading by the following vote: AYES: All members of said City Council shown present above voted "Aye." NOES: None. 5. That at the second of the aforesaid meetings, all of the members and officers of said City Council were present, except the following absentees: /)vn/t , and said Ordinance was introduced for the consideration of said City Cou:-,cil by its presiding officer, and read in full, and, upon mo7__on duly made and seconded, said Ordinance was passed on second and final reading by the following vote: _7 . 11 AYES: All members of said City Council shown present above voted "Aye." That a true, full and correct copy of the aforesaid Ordinance passed at the meetings described in the above and foregoing paragraphs is attached to and follows this Certifi- cate; that said Ordinance has been duly recorded in said City Council's minutes of said meetings; that the above and foregoing paragraphs are true, full and correct excerpts from said City Council's minutes of said meetings pertaining to the passage of said Ordinance; that the persons named in the above and foregoing paragraph are the duly chosen, qualified and acting officers and members of said City Council as indicated therein; that each of the officers and members of said City Council was duly and sufficiently notified officially and personally in advance, of the time, place and purpose of the aforesaid meetings, and that said Ordinance would be introduc- ed and considered for passage at said meetings, and each of said officers and members,,consented, in advance, to the holding of said meetings for such purpose; that said meetings were open to the public, and public notice of the time, place and purpose of said meetings was given, all as required by Vernon's Ann.Civ.St. art. 6252-17, as amended. 7. That the Mayor of said Cityhas approved, and hereby approves, the aforesaid Ordinance; that the Mayor and the City Secretary of said City have duly signed said Ordinance; and that the Mayor and the City Secretary of said City hereby declare that their signing of this Certificate shall con- stitute the signing of the attached and following copy of said Ordinance for all purposes. THE STATE OF TEXAS COUNTY OF WILLIAMSON CITY OF GEORGETOWN WHEREAS, under the provisions of the Hospital Authorities Act (Chapter 472, Acts of the 55th Legislature, Regular Session, 1957, codified as Vernon's Ann.Civ.St. art. 4437e,) the City Council of the City of Georgetown is authorized and empowered to create a Hospital Authority if the creation thereof would be to the best interest of the City and its inhabitants; and WHEREAS, the City Council has caused an investigation to be made and now finds and determines that it is to the best interest of the City and its inhabitants to create a Hospital Authority under the provisions of the aforesaid Act; and WHEREAS, it is hereby officially found and determined: that a case of emergency or urgent public necessity exists which requires the holding of the meeting at which this Ordinance is passed, such emergency or urgent public necessity being that the proceeds of the Bonds of the Hospital Author- ity are immediately necessary for public improvements which will contribute to the preservation of the public peace, health, safety, and welfare; and that said meeting was open to the public, and public notice of the time, place, and purpose of said meeting was given, all as required by Vernon's Ann.Civ.St. art. 6252-17, as amended. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN: Section 1. That, it is hereby officially found and determined that it is to the best interest of the City and its inhabitants to create a Hospital Authority. Section 2. That, by virtue of the power conferred upon the City by the Hospital Authority Act, a Hospital Authority comprising the territory included within the boundaries of the City of Georgetown, Texas, is hereby created as a body politic and corporate, and Georgetown Hospital Authority is hereby designated as the name by which said Authority shall be known. Section 3j, That, Georgetown Hospital Authority shall be governed by a Board of Directors consisting of nine (9) members; that the first Directors for said Authority shall be H. R. Gaddy. Jr. Douglas.M. Benold James L. Shepherd John R. Webb Richard W. Pearce Jay C. Sloan Elmer K. F-red.ericson Basil A. Phillips tha-rle' , A.` Forbes and that each of said directors shall, unless other provision is made in the bond resolution or trust indenture in connec- tion with the issuance of bonds as provided in the Hospital Authority Act, serve for a term of two years from the date hereof and until their successors have been appointed by the Governing Body of the City of Georgetown, Texas, and have duly qualified. Section 4. That it is hereby officially found and determined: that a case of emergency or urgent public neces- sity exists which requires the holding of the meeting at which this Ordinance is passed, such emergency or urgent public necessity being that the proceeds of the Bonds of the Hospital Authority are immediately necessary for public im- provements which will contribute to the preservation of the public peace, health, safety, and welfare; and that said meeting was open to the public, and public notice of the time, place, and purpose of said meeting was given, all as required by Vernon's Ann.Civ.St. art. 6252-17, as amended.
