An Ordinance of the City Council of the City of Georgetown,
Texas, amending section 10.12.090(B) of the Code of Ordinances to
establish a 20 -MPH school speed zone on a portion of Katy Crossing
Boulevard.
ITEM SUM KARY
Katy Crossing Boulevard is a direct route through the Katy
Crossing subdivision between FM 971 and Cooper Elementary. Many
cars have started using this neighborhood road to access the school
avoiding the traffic signal on 971 and the main entrance on Inner
Loop. A traffic investigation has been conducted by the City's
Police Services and Transportation Services. The investigation
indicated the additional vehicle and pedestrian traffic before and
after school warrants a timed 20 MPH school speed zone.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS, AMENDING SECTION 10.12.090(8.) OF THE
CODE OF ORDINANCES OF THE CITY OF GEORGETOWN, TEXAS TO
ESTABLISH A 20 -MPH SCHOOL SPEED ZONE ON A PORTION OF KATY
CROSSING BOULEVARD; PROVIDING A CONFLICT CLAUSE;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR
PUBLICATION; AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the Georgetown Police Department has conducted a traffic
investigation on Katy Crossing Boulevard near Cooper Elementary School; and
WHEREAS, the traffic investigation revealed a significant increase in average daily
traffic in that area due to parents accessing the rear of the school by driving through the
Katy Crossing Subdivision; and
WHEREAS, the additional traffic through this neighborhood has created safety
concerns for students and pedestrians using the neighborhood as their sole means of
accessing the elementary school; and
WHEREAS, the City Council of the City of Georgetown, Texas, hereby finds it
necessary and proper and in the best interest of the citizens of Georgetown to establish
a 20 -mph school speed zone on a portion of Katy Crossing Boulevard, which will connect
with the existing 20 -mph school speed zone on the school property, for purposes of
promoting a safer environment for students and pedestrians in that area.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS, THAT:
SECTION 1. The facts and recitations contained in the preamble of this ordinance
are hereby found and declared to be true and correct, and are incorporated by reference
herein and expressly made a part hereof, as if copied verbatim. The City Council hereby
finds that this ordinance implements Transportation Policy 1 of the Century Plan - Policy
Plan Element, which states: 'The City will encourage a transportation system that provides
for the safe and efficient movement of traffic, promotes the economic interests of the
community, and adequately serves the personal needs of individuals", and further finds
that the enactment of this ordinance is not inconsistent or in conflict with any other Century
Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan.
SECTION 2. Chapter 10.12.090(B.)(9.) of the Code of Ordinances of the City of
Georgetown, Texas is hereby amended to add the following as the next consecutively

The recent completion of The Rivery Bridge and approaches has
tied the two ends of Rivery Boulevard together and opened the
roadway to traffic. Staff conducted an engineering and traffic
investigation to determine the prima facie speed limit to be 40
miles per hour.

PUBLICATION AND SETTING AN EFFECTIVE DATE.
WHEREAS, due to the recent completion and opening of the Rivery Bridge,
Rivery Boulevard, which runs between Ranch Road 2238 (Williams Drive/Andice
Highway) and the southbound (west) frontage road of IH -35, is open for use by the
public; and
WHEREAS, Rivery Boulevard is classified as an arterial roadway; and
WHEREAS, Transportation Services and the Police Department have conducted
an investigation of the traffic conditions on Rivery Boulevard using engineering
principles to determine the prima facie maximum speed limit and recommend it be
established at 40 miles per hour; and
WHEREAS, the City Council of the City of Georgetown, Texas, deems it
necessary and proper to amend Section 10.12.090(D.) of the Code of Ordinances of the
City of Georgetown, Texas, entitled "40 Mile Per Hour Zones", to add Rivery Boulevard
from Ranch Road 2338 (Williams Drive/Andice Highway) to the southbound (west)
frontage road of IH -35.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF GEORGETOWN, TEXAS, that:
SECTION 1. The facts and recitations contained in the preamble of this

SECTION 2. Section 10.12.090(D.) of the Code of Ordinances of the City of
Georgetown, Texas, entitled "40 Mile Per Hour Zones", is hereby amended to add the
following as the next consecutively numbered paragraph:

SECTION 3. This ordinance shall be and is hereby declared to be cumulative of
all other ordinances of the City of Georgetown, and this ordinance shall not operate to
repeal or affect any of such other ordinances, except insofar as the provisions thereof
might be inconsistent or in conflict with the provisions of this ordinance, in which event
such conflicting provisions, if any in such other ordinance or ordinances are hereby
superseded.
SECTION 4. If any provision of this ordinance or application thereof to any
person or circumstance, shall be held invalid, such invalidity shall not affect the other
provisions, or application thereof, of this ordinance which can be given effect without the
invalid provision or application, and to this end the provisions of this ordinance are
hereby declared to be severable.
SECTION 5. The Mayor is hereby authorized to sign this ordinance and the City
Secretary to attest. This Ordinance shall become effective and be in full force and effect
ten (10) days on and after publication in accordance with the provisions of the Charter of
the City of Georgetown.

An Ordinance of the City Council of the City of Georgetown
designating a portion of 9th Street between Walnut and College
Streets as one-way (eastbound) and directing the Chief of Police to
erect the appropriate signage therefor.
ITEM SUMMARY
Williams Elementary School has a parent pick-up and drop-off
lane designated along College Street. The lane starts on the west
side of College Street at 9th Street. Walnut is used as a primary
route to access the drop-off area. Ninth Street is used to cross
from Walnut to College. Ninth Street is a substandard, narrow
section of right-of-way at this area and is not suitable to use as
a school's primary access route. During pick-up and drop-off
times, residents have difficulty getting out of driveways due to
the traffic. Crowding of this narrow section of roadway also
raises some pedestrian safety concerns. City and school staff have
been unsuccessful getting adequate results when asking for
voluntary compliance of drivers to go one more block and use 8th
Street to get from Walnut to College. Residents living on 9th Street
are all in favor of the one-way designation.

WHEREAS, the Williams Elementary School facilities have recently been
reconfigured such that parents dropping off and picking up students are driving west on
9th Street between Walnut and College to access the school; and
WHEREAS, 9th Street between Walnut and College is narrow, substandard and
not suitable for use as a primary means of access to the school; and
WHEREAS, the additional traffic on this section of 9th Street has created a safety
hazard for pedestrians and local residents in that area; and
WHEREAS, the Georgetown Police Department and Transportation Services
staff have worked with the Georgetown Independent School District to achieve voluntary
cooperation from parents to use an alternate route, but have been unsuccessful; and
WHEREAS, the designation of 9th Street between Walnut Street and College
Street as a one-way (eastbound) street would reduce the traffic and increase the level
of safety thereon; and
WHEREAS, Section 10.08.070 of the Code of Ordinances of the City of
Georgetown assigns the duty of erecting traffic signs on streets within the City to the
Chief of Police as directed by the City Council; and
WHEREAS, the City Council of the City of Georgetown, Texas deems that the
designation of 9th Street between Walnut Street and College Street for purposes of
reducing safety hazards to parents, students and residents in that area as a one-way
(eastbound) street, and the erection of the appropriate signage thereon, is necessary
and proper and in the best interest of the citizens of Georgetown.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY

might be inconsistent or in conflict with the provisions of this ordinance, in which event
such conflicting provisions, if any in such other ordinance or ordinances are hereby
superseded.

Consideration of an ordinance abandoning a portion of the First Street right-of-way
between Rock Street and Austin Avenue (Second Reading).
ITEM SUMMARY:
On November 5, 2003, the City received application from Gavurnik Group, Inc.
("Gavurnik") for the abandonment of a portion of the unopened First Street right-of-way
between Rock Street and Austin Avenue along the south side of the South San Gabriel
River.
Gavurnik owns property south of and adjacent to the right-of-way that it plans to develop
and, therefore, desires to acquire the right-of-way to enhance the usability and
appearance of its property.
Staff has determined that there are no utilities located within the area to be abandoned.
However, the proposed transaction provides for the reservation of a 15 -foot -wide public
utility easement along northern boundary of the property to be abandoned.
The attached proposed ordinance abandons the subject right-of-way and authorizes the
City Attorney to prepare the necessary documents to affect the transaction.
FINANCIAL IMPACT/SPECIAL CONSIDERATIONS:
The fair market value of the property as determined by Kokel-Oberrender-Wood
Appraisal Associates is $15,400.00. As consideration for the City's abandonment of the
property, Gavurnik has requested to construct certain public park improvements to be
designated and approved by the City, as an in-kind payment of $15,400.00. The
proposed ordinance gives the Applicant the option to either build or bond such
improvements or pay cash for the right-of-way prior to the City's execution and
recordation of a deed abandoning the right-of-way.

WHEREAS, the City of Georgetown has received an Application from
Gavurnik Group, Inc. ("Applicant") for the Abandonment of the street, alley,

Nicholas Porter Survey, Abstract No. 497, in the City of Georgetown, County of
Williamson, being a portion of 1St Street as shown on map or plat thereof
recorded in Volume 5, Page 211, Deed Records, Williamson County, Texas; said
0.202 acres being more particularly described by metes and bounds and sketch
attached hereto as Exhibits A"and "B" (the "Property") , respectively; and
WHEREAS, notice of the time and place, where and when this Ordinance
would be given a public hearing and considered for final passage, was published
in the Williamson County Sun, a newspaper of general circulation in the City of
Georgetown, said publication being on the 19tt' day of November, 2003, the same
being more than seventy-two (72) hours prior to the time designated for said
hearing; and
WHEREAS, upon considering the Application and additional information
pertaining to the Application, the City Council now finds that (a) there are no
existing utilities located within the property to be abandoned; OR (b) the utilities
existing in the area of the street, alley, and/or public right-of-way will be
sufficiently protected by being either relocated or placed into easements and that
the utility companies serving the area including and surrounding the right-of-way
have determined that their utilities, if existing, will also be sufficiently protected by
the same means; and
WHEREAS, the fair market value of the Property is $15,400.00 (see
Exhibit "C" - value of entire right-of-way tract $20,000.00; value of part to be
abandoned $15,400.00). Applicant may pay this amount in cash or in lieu of
cash payment for the fair market value of the Property, Applicant may construct
certain public park improvements adjacent to the Property and in Blue Hole Park,
provided that such improvements are not otherwise required by the Unified
Development Code or other City development regulation related to any future
development of Lots 1 and 8, Block 3, in the City of Georgetown according to
map or plat thereof in Volume 5, Page 211, of the Williamson County Deed

following policy of the Century Plan - Policy Plan Element(s):
Growth and Physical Development Focus End 3.00, which states:
"Citizens, business owners and organizations enjoy the benefits of
well-planned land usage in which conflicting needs are balanced";
and
Economic Development Focus End 1.01, which states: "Existing
undeveloped sites in Georgetown are put to beneficial use"; and
The City Council further finds that the adoption of this resolution is not
inconsistent or in conflict with any other Century Plan Policies, as required by
Section 2.03 of the Administrative Chapter of the Policy Plan.
SECTION 2. That the following described portion of a street, alley, and/or
public right-of-way, as described on Exhibits "A" and "B" attached hereto and
made a part of this ordinance for all purposes, be, and the same is hereby
abandoned, vacated and closed insofar as the right and title of the public is
concerned.
SECTION 3. That said portion of a street, alley, and/or public right-of-way
is not needed for public purposes and it is in the public interest of the C ityof
Georgetown to abandon said described portion the street, alley, and/or a public
right-of-way.
SECTION 4. That the abandonment provided for herein shall extend only
to the public right and title in and to the tracts of land described in SECTION 2 of
this ordinance, and shall be construed only to that interest the governing body of
the City of Georgetown may legally and lawfully abandon.
SECTION 5. The City Attorney is hereby authorized to issue and the
Mayor authorized to execute a Deed in the form attached hereto as Exhibit "D"
and the City Secretary is authorized to attest thereto on behalf of the City of
Georgetown, and to execute any other documentation necessary to affect the
transaction.

SECTION 6. Prior to the City's execution of the deed abandoning the
Property and recordation thereof in the real property records of Williamson
County, Applicant shall:
1. Pay to the City the sum of $15,400 cash; or

$15,400 for construction of the Public Improvements; or
3. Complete the construction of the Public Improvements in
accordance with all applicable City regulations.
SECTION 7. Pursuant to Section 4.02.040.A. of the City of Georgetown
Unified Development Code, the Property shall have the same zoning as the
adjacent lots (being Lots 1 and 8, Block 3, in the City of Georgetown according to
map or plat thereof in Volume 5, Page 211, of the Williamson County Deed
Records). In addition, upon execution and recordation of the Deed, the Property
will be deemed to be a part of the adjacent lots (being Lots 1 and 8, Block 3, in
the City of Georgetown according to map or plat thereof in Volume 5, Page 211,

City of Georgetown and Roming, Parker and Kasberg, L.L.P. for engineering services related to the
Southeast Arterial One Project Phase 1 in the amount of $212,000.00 and a project budget of

ITEM SUMMARY:
The Wilbur Smith Transportation Study identified the Southeast Arterial One as a priority
project. This roadway is critical to help alleviate traffic congestion on State Highway 29, by providing
an initial connection between State Highway 130 and the Inner Loop. Phase One will consist of a
two-lane section, from the intersection of County Road 110 and the Inner Loop, to the future
intersection of State Highway 130 with County Road 104.
Engineering will provide the schematics, Right -of -Way requirements, environmental and
archaeological clearances for the full future section of the roadway, as well as the construction
plans for the phase one two-lane section of roadway. The engineering proposal is in the amount
of $212,000.00, with a project budget of $264,000.00. The Right -of -Way acquisition is scheduled
for the following year.

This letter proposal is in response to your request for basic and special engineering services required
to provide construction drawings for street and drainage improvements for:
The Southeast Arterial One Project Phase I
The charges for this work are shown on Attachment "A" of this letter. We have priced the work
according to the facts that we know about the project as of this date. Lump Sum charges are shown
and will not change unless the scope of work is expanded, at which time we will meet with you and
plan accordingly. The following are tasks that we have included in the work schedule:
PRELIMINARY ENGINEERING PHASE. (Phase I) This phase involves determination of
project scope and economic and technical evaluation of feasible alternatives. Services during this
phase include:
1. Obtaining and reviewing available data and consulting with the City to clarify and
define the CITY's requirements for the project.
2. Advising the CITY as to the necessity of providing or obtaining from others additional
data or services. These additional services may be include photogrammetry,
investigations and consultations, compilation of hydrological data, traffic studies,
materials engineering, assembly of zoning, deed, and other restrictive land use
information, and environmental assessments and impact statements.

3. Identifying and analyzing requirements of governmental authorities having jurisdiction
to approve the design of the project, and participating in consultations with such
authorities.
4. Providing analyses of the CITY's needs, planning surveys, and comparative
evaluations of prospective sites and solutions.
5. Providing a general economic analysis of the CITY's requirements applicable to
various alternatives.
6. Consulting with the CITY, reviewing preliminary reports, clarifying and defining the
project requirements, reviewing available data, and discussing general scheduling.
Conferences may also be required with approving and regulatory governmental
agencies and affected utilities.
7. Advising the CITY as to whether additional data or services are required, and
assisting the CITY in obtaining such data and services.
8. Analysis of existing connectivity of the roadway system
9. Analysis of the final schematic of the connection of Southeast Inner Loop to the
proposed SH130.
10. Analyze the phasing of a two lane connection from Southeast Inner Loop to SH130
with future expansion to four lanes with an intersection interchange.
FINAL DESIGN PHASE. (Phase 1) This phase of project development is undertaken only after the
CITY has approved the preliminary engineering phase material. The basic services for the final
design phase includes:
1. Preparing construction drawings and specifications showing the character and extent
of the project based on the accepted preliminary engineering documents.
2. Preparing and furnishing to the CITY a revised opinion of probable costs based on the
final drawings and specifications.

3. Research and obtain regulatory permits from local, state, or federal authorities. This
is distinguished from and does not include detailed applications and supporting
documents for government grant-in-aid or planning grants that would be furnished as
additional services. Fees for any local, state or federal construction permit
applications are not included as part of the professional fee charges. These will be
paid by the CITY.
4. Preparing basic documents related to construction contracts for review and approval
by the CITY (and the CITY's legal and other advisors). These may include contract
agreement forms, general conditions and supplementary conditions, invitations to bid,
instructions to bidders, insurance and bonding requirements, and preparation of other
contract -related documents.
5. Furnishing to the CITY the specified number of copies of drawings, specifications,
and other contract documents.
6. Design the final schematic of the intersection and traffic flow of the proposed
Southeast Arterial One and Southeast Inner Loop and the connection with SH130.
7. Completion of environmental, archaeological and geotechnical surveys and
exploration.
8. Design surveys including the transfer of validated benchmarks to the proposed area.
9. Design and submittal of WPAP reports to the TCEQ for project acceptance in the Re-
charge Zone of the Edwards Aquifer.
10. Meet regularly with the City of Georgetown Staff to review the progress of the design
and coordinate any conflicts that arise.
