TEX 13,102. WHEREAS, under the provisions of Title I of the Housi,Act of 1949, as amended, the Department of Housing and Urban Development is 1 4uthorized to provide i financial assistance to Local Public Agencies for undertakink and carrying out urban renewal projects; and WHEREAS, it is provided in such Act that contracts for Pinancial aid there- under shall require that the Revised Urban Renewal Plan for ;he respective project area be approved by the governing body of the locality in wh ch the project is situated and that such approval include findings by the gove,ning body that: (1) the financial aid to be provided in the contract is nece nary to enable the project to be undertaken in accordance with the Revised Urba Renewal Plan; (2) the Revised Urban Renewal Plan will afford maximum opporlunity, consistent with the sound needs of the locality as a whole, for the reMilitation or redevelopment of the urban renewal area by private enterprisy; (3) the Revised Urban Renewal Plan conforms to a general plan for the develo went of the locality as a whole; and (4) the Revised Urban renewal Plan gives due consideration to the provision of adequate park and recreational areas and facilildes, as may be de- sireable for neighborhood improvement, with spe0a consideraldon for the health, safety, and welfare of children residing in the general vicitity of the site covered by the Plan; and WHEREAS, the Georgetown Urban Renewal Agency (herein Mled the "Local. WHE1iffiAS, there has been prepared and referred to the City Council of the Locality (herein called the "Governing Body") for review and approval a Re- vised Urban Renewal Plan for the Project Area, dated February 13,,1968, and consisting of 15 pages and 2 exhibits and 3 maps containing 3 sheets; WHEREAS, the Revised Urban Renewal Plan has been approved the Governing Body of the Local public Agency, as evidenced by the copy o certified resolution approving the Urban Renewal Flan, whic and said body's duly is attached thereto; WHEREAS, a general plan has been prepared and is recog&zed and used as Y guide for the general development of the Locality as a whol and WHEREAS, the Planning and Zoning Commission, which is I e duly designated and acting official planning body for the Locality, has sub utted to the Govern- ing Body its report and recommendations respecting the ReviE!d Urvan Renewal flan for the Project area and has certified that the devise � Urban Renewal Plan conforms to the general plan for the Locality as a who, and the Govern- ing Body has duly considered the report, recommendation, an� certification of the planning body; and WHEREAS, the Revised Urban Renewal Plan for the Project area prescribed certain land uses for the Project area and will require, amc tig other things, changes in zoning, the vacating ,and removal of streets, all e,irs, and other public I ways, the establishment of new street patterns, the location and relocation of sewer and water mains and other public facilities, and other public action; and WHEREAS, the Local Public agency has prepared and submi , ted a program for the relocation of individuals and families that may be lisp l ced as a result of carrying out the Project in accordance with the Revised Urbaii Renewal Plan; and WHEREAS, there have also been presented to the Governirfly Body information and data respecting the relocation program which has been pr pared by the Local Public Agency as a result of studies, surveys, and inz rections in the Project area and the assembling and analysis of the data anilinformation ob- tained from such studies, surveys, and inspection; and WHEREAS, the members of the Governing Body have general knowledge of the conditions prevailing in the Project area and of the availability of proper housing in the Locality for the relocation of individuals arfil families that may be displaced from the Project area and, in the light of such knowledge of local housing conditions, have carefully considered and reviewed such pro- posals for relocation; and WHEREAS, it is necessary that the Governing Body take al)propriate offici action respecting the relocation program and the Revised Urt n Renewal Plan f Project, in conformity with the contract for financial assistance between the d through the Local Public Agency and United States of America, acting by in Department of Housing and Urban Development; I I I I V. That it is hereby dound and determined that the Revised Urban Renewal Plan for the Project area conforms to the general plan of the Locality. V1. That it is hereby found and determined that the financial aid provided and to be provided pursuant to the contract for Federal financial assistance per- taining to the Project is necessary to enable the Project to be undertaken in accordance with the Revised Urban Renewal Plan for the Project area. Vita That it is hereby found and determined that the Revised Urban Renewal Plan for the Urban Renewal Area will afford maximum opportunity, consistent with the sound needs of the Locality as a whole, for the Urban Renewal of the Area by private enterprise. That it is hereby found and determined that the Revised Urban Renewal Plan for the Urban Renewal Area gives due consideration to the provision of adequate park and recreational areas and facilities, as may be disireable for neighborhood improvement, with special consideration for the health, safety,aad welfare of children residing in the general vicinity of the site covered by the Plan. Ix. That it is hereby found and determined that the program for the proper relocation of individuals and families displaced in carrying out the Project in decent, safe, and sanitary dwellings in conformity with acceptable standards is feasible and can be reasonably and timely effected to permit the proper prosecution and completion of the Project; and that such dwellings or dwilling units available or to be made available to such displaced individuals and families are at least equal in number to the number of displaced individuals and families, are not generally less desireable in regard to public utilities and public and commercial facilities than the dwellings of the displaced individ- uals and families in the Project area, are available at rents or prices within the financial means of the displaced individuals and families, and are reasonably accessible to their places of employment. X. That, in order to implement and facilitate the effectuation of the Revised Urban Renewal Plan hereby approved, it is found and determined that certain official action must be taken by this Body with reference, among other things, to changes in zoning, the vacating and removal of streets, alleys, or other public ways, the establishment of new street patterns, the location and re- location of sewer and water mains and other public facilities, and other public actions, and, accordingly, this Body hereby (a) pledges its cooperation in helping to carry out the Revised Urban Renewal Plan; (b) requests the various officials, departments, boards, and agencies of the Locality having administra- tive responsibilities in the premises likewise to cooperate to such end and to exercise their respective functions and powers in a manner consistent with the Revised Urban Renewal Plan; and (c) stands ready to consider and take appropri- ate action upon proposals and measures designed to effectuate the Revised Urban Renewal Plan. WHEREAS, the necessary prerequisites and requirements I the Georgetown Urban Renewal Agency and the City of Georgetown and its ageies have been complied with and the City Council of the City of Georgetowr., following a public hearing, has by resolution approved the Revised Urbar. He is the duly qualified and acting City Secretary of the City of Georgetown, Texas, (hereinafter called the "Locality"), and the custodian of the records of the Locality, including the minutes of the proceedings of the City Council of the City of Georgetown, Texas (hereinafter called the "Governing Body"); and is duly authorized to execute this certificate. 2. Attached hereto is a true and correct copy of a resolution, including the WHEREAS clauses, adopted at a meeting of ,the Governing Body, held on the 8th day of ril 1968 (hereinafter called the "Resolu- tion of the Governing Body"). 3. The Resolution of the Governing Body has been duly recorded in the minutes of said meeting and is now in full force and effect. 4. The meeting was duly convened and held in all respects in accordance with law and the bylaws of the Locality. To the extent required by law and bylaws, due and proper notice of said meeting was given. A legal quorum of members of the Governing Body was present throughout the meeting, and a le- gally sufficient number of members of the Governing Body voted in the proper manner for the adoption of the Resolution of the Governing Body. This, agreementis made and entered into on this the 8th Z- day of April, A.D., 1968, by and between the Urban Renewal Agency of the City of Georgetown, Texas, (hereinafter called and referred to as the "Agency"), and the City of Georgetown, Texas, a Municipal Corporation (hereinafter called and referred to as the "City"), WITNESSETH: IffIEREAS, the Agency is a public body corporate and politic, created by the laws of the State of Texas pertaining thereto, specifically the Texas Urban Renewal Law; and WHEREAS, the Agency with the aid and cooperation of the City proposes to under -take and carry out an urban renewal program in the City of Georgetown, Texas, including but not limited to the so-called South San Gabriel Urban Renewal Project TEX R-102, (hereinafter called the "Project") in accordance with the Revised Urban Renewal Plan therefore, heretofore approved by the City Council bearing the date of the . 8th day of Agril, 1968 and pursuant to the provisions of the laws of the State of Texas as herein - above referred to; and WHEREAS, the Agency proposes in carrying out the Revised Urban Renewal Plan; and WHERE.,kS, the Agency proposes to enter into a Loan and Grant Contract with the Department of Housing and Urban Development, an Ageicy of the United States of America, providing for financial assistance pursuant to Title I of the Housing Act of 1949, as amended, for the purpose of carrying out the provisions of the Revised Urban Renewal Plan, in the sum of: (1) A Project Temporary Loan in the amount of $2,538,,,952.00 (2) A Project Capital Grant in the maximum amount avar able for the Project. These facilities are to be installed by the,Urban Renewal Agency and the identification and estimated cost to the City is as follows: STREETS: Timber Street from 4th Street to South East Project Boundary. 17th Street along South Boundary and North Part of Bridge Street. 19th Street along South Project Boundary. Estimated Cost 50% Paid by City Rucker Street, from Urban Renewal Area limits, 355'+ Northerly of West 19th Street to West 19th Street; and West 19th Street, from Rucker Street to Urban Renewal Area limits, 70'+ Westerly of Rucker Street; including the intersection of Wit 19th Street with Rucker Street S 3,607.00 WATER LINES: 19th Street from Railroad to School Property line on Boundary Street Estimated Cost 585.00 DMIINAGE FACILITIES: That portion of Drainage Facilities outside Project Area from l8th Street to 17th Street on Southwest Side of Project. Estimated Cost In addition, the City of Georgetown anticipates Non -Cash Grant-in-aid Credit for Parcel OL 1-1 to be donated to the Project by Williamson County, Texas, presently estimated at $6,500, the fair market value of which to be estab- lished by two appraisals. The City agrees to accept from the Urban Renewal Agency Park Sites RI, UI, VI, FIO, Fll, and EIO to be provided in the Urban Renewal Program and to assume the responsibility of maintenance and upkeep of these Park Areas. The City agrees to contribute to the Project, either in the form of cash or Non -Cash Grant-in-aid facilities, such amounts as shall be required to cover any deficit in required Local Grant-in-aid which shall develop if the Department of Housing and Urban Development shall not approve the full esti- mated amount of Grant-in-aid Credit for the facilities itemized above and to cover any deficits which shall exist or develop by failure to provide any of the foregoing facilities at the indicated estimated cost thereof. The City agrees to sell Parcels OL 5-10, OL 6-1, CPA 15 and CPA 16 to the Urban Renewal Agency at the fair market value as evidenced by two acceptable appraisals or in lieu thereof, consent to their condemnation. The City agrees to vacate streets, alleys and other public rights -of - way and to accept dedication of streets, alleys and other public rights - of -way in accordance with the Revised Urban Renewal Plan. The City agrees to enforce by proper action the provisions of all munici- pal codes and ordinances relating to the health, welfare, safety, good living conditions, and the prevention of slum blighted areas in the City of Georgetown, and particularly in the attached described Urban Renewal Area and to continue such enforcement in the interest of the continuing success of the Project. 122 The City of Georgetown, Texas, recognizes that Title VI of the Civil Rights Act of 1964 and the regulations and policies of the Department of Housing and Urban Development effectuating the Title prohibit descriminati-on on the ground of race, color, or national origin in the poliies and prac- tices of any public facility, or educational institution res onsible for proposed credit to the locality's share of the cost of an ur an renewal project receiving financial assistance from the United States. The ity of Georgetown, Texas, hereby assures the United States and the Secretary of Housing and Urban Development all the facilities set forth herein, incluling particu- larly the City Parks, for the South San Gabriel Renewal Proj!ct, T. R-102, will be available to and serve all persons without regard to,irace, color, or national origin. The City further agrees to cooperate with the Agency in;all reasonable re- spects to such extent as may be necessary and required in or t ' ler to bring the South San Gabriel Urban Renewal Project TEX 11-102 to final afid successful completion.
