AN ORDINANCE CONDITIONALLY AMENDING THE
"ZONING ORDINANCE" PASSED AND ADOPTED BY THE
CITY COUNCIL OF THE CITY OF GEORGETOWN,
TEXAS, ON THE 12th DAY OF FEBRUARY, 1968,
AMENDING A PART OF THE MAP OR THE ORIGINAL
ORDINANCE: TO CHANGE THE PROPERTY OF
NEWBERG-PESCHEL PARTNERSHIP ACCORDING TO THE
MAP THEREOF FROM RS RESIDENTIAL SINGLE TO
C -2A COMMERCIAL, AS HEREINAFTER SET FORTH:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN,
TEXAS:
WHEREAS, an application has been made to the City Council
for the purpose of changing the zoning ordinance on the
following described real estate:
Being all of that certain tract or parcel of land
lying and being situated in the City of Georgetown
in Williamson County, Texas, and being Lots 1, 2,
and 3, Block 3, COUNTRY CLUB ESTATES, commonly known
as 1208 Williams Drive, and being that certain
property conveyed to Newberg-Peschel Partnership by
deed dated February 4, 1982, and recorded in Cabinet
A, Slide 119, Plat Records of Williamson County,
Texas.
AND WHEREAS, the applicants for such zoning change have
:sted of said city that such change of zoning be made
itioned on use of said tract as a site for the sale of new
sed automobiles only and not for mechanical repairs;
AND WHEREAS, the City Planning Commission has approved the
changing of said Zoning Ordinance on the above described
property from RS Residential Single Family to C -2A Commercial,
which said meeting was held on the 23rd day of March, 1982; and
WHEREAS, written notice was given to all of the owners of
lots within 200 feet of the above described property as
required by law; and
WHEREAS, on March 23, 1982 the Planning and Zoning
Commission recommended approval of such requested change by the
City Council of the City of Georgetown, Texas:
NOW, THEREFORE, BE IT ORDAINED by the City Council of the
City of Georgetown, that the Zoning Ordinance, and the Zoning
Map of the City of Georgetown, be amended so that the property
described above shall be and the same is hereby removed from
"RS Residential Single Family" to "C -2A Commercial," subject to
the condition, evidenced by the supplemental application
executed by Robert Newberg and Harold Peschel dated April 13,
1982, which is to be recorded in the Deed Records of Williamson
County, Texas, for notice purposes. Said condition being that
if said land shall cease to be used as a location for the sale
of new or used cars only then such zoning shall revert back to
C-1 Commercial and the Zoning Ordinance and Zoning Map shall
accordingly be, ipso facto, changed upon the occurrence of such
condition. An affidavit made by the City Manager of the City
of Georgetown shall constitute prima facie proof that said
condition has occurred and that the zoning classification has
reverted from C -2A Commercial to C-1 Commercial.
