I l 1 1 1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS (` CITY") AUTHORIZING A MULTIPLE USE AGREEMENT ("MUA") WITH THE TEXAS DEPARTMENT OF TRANSPORTATION ("TxDOT") CONCERNING THE CONSTRUCTION OF A SIDEWALK WITHIN THE FM 1460 RIGHT OF WAY BETWEEN QUAIL VALLEY DRIVE AND SOUTH AUSTIN AVENUE AND CONFIRMING THE CITY'S INTENT TO MAINTAIN THE SIDEWALK AND COMPLY WITH THE TERMS OF THE MUA„ AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, on �t fl\.&o l\ ,`kOtt, the City was awarded a Community Development Block Grant ("CDBG Grant") for the construction and maintenance of sidewalks within the City of Georgetown; and WHEREAS, the City has identified the north/east side of FM 1460 between Quail Valley Drive and South Austin Avenue as an area in need of sidewalk, and WHEREAS, FM 1460 under the jurisdiction and control of TxDOT; and WHEREAS, the attached Multiple Use Agreement sets out the terms by which TxDOT will authorize the City to construct a public sidewalk within FM 1460 right of way between Quail Valley Drive and South Austin Avenue. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. [he facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. the City Council further finds that the adoption of this resolution is not Inconsistent or in conflict with any 2030 Comprehensive Plan Policies. SEC 1'1ON 2. 1'he City Council of the City of Georgetown finds it to be in the best interest of the citizens of Georgetown to enter into the Multiple Use Agreement attached hereto as Exhibit "A" made a part hereof and the City has no objection thereto. The City hereby confirms its intent to maintain the subject sidewalk. Resolution No. 11 1 1 1 Authorizing Multiple Use Agreement with TxDOT re FM 1460 Sidewalk Page 1 of 2 SECTION 3. The Mayor is herby authorized to sign this Resolution and the City Secretary to attest thereto on behalf of the City of Georgetown. This resolution shall be effective immediately upon adoption.
